Parking charge from Cascade Financial Ltd

Hi,

I'm not sure if there have been any other threads regarding this, I created this account for the sole purpose of seeking advice and I'm not entirely sure how to go about it really. So apologies in advance if it's already been dealt with elsewhere.


I received a parking charge from Cascade Financial Ltd/National Parking Control. My car was parked in the car park to the block of flats I live in. The incident date is 3rd May, and the charge was issued on 26th March this year.

The charge has been sent to my mums address as the car is registered there (I'm only 23, so it's cheaper to be a named driver on her insurance) and they got the info from DVLA.

It's not a chargeable car park, it's simply a plot of land with some car parking spaces in.

The YMCA (my landlord) have had the area covered to stop residents parking there, but people are continuously parked there who either work there or visit the offices for work, and in the picture of my car is ANOTHER car who I know to belong to another resident and as of today they told me they haven't received a ticket themselves...

To whom/how can I appeal? And on what grounds? It's for £100 but they will accept £60 if it's paid within 14 days.

I'm sorry if some of the information is unnecessary, I'm just at a bit of a loss.

    The other car is a red herring.

    You shouldn't park in a place where you are not allowed, but it appears in this case you have got away with it. I would not advise doing it again.

    The keeper should appeal on the basis that they were not the driver an keeper liability does not apply. The identity of the driver should not be disclosed.

    There was no ticket left on my windscreen, from what I can gather from some googling of the company the landlord used, they just take a picture and send it to the company who issue the charge.

    The date of incident is logged as 03-03-2016
    The PCN issue date is 26-05-2016. Sorry, I got this the wrong way round!


    There are two cars in the picture, mine and the other car. The other car (as of today) haven't received a ticket. How could that be fair?

    I tried to add a picture of the letter but it won't let me because I'm a new member.

    The letter says that because they don't know who was parking, that they'll just take action against her if it's not paid because it's legally her car.

    Well if those dates are right, unless you have missed something out, then they will struggle with keeper liability because of the time it has taken to issue the Notice to Keeper.

    Perhaps the other car belongs to private parking company, it wouldn't be unknown for these companies to park cars where they shouldn't be to entice other vehicles to park nearby. A bit like a hunter using decoys to attract their prey

    That's very true, but can they get my info from the DVLA if I'm a registered driver? If so could they come back with a claim of 'well it could be her'?


    The car definitely belongs to another resident as I know her fairly well, I knocked and asked her and she confirmed it was her car. There's no 'parking officers' involved it's just the staff at the YMCA building who take the pictures and send it off to the company.

    actually as no ticket on car , a lot more than 14 days

    Run by Mohammed Buksh after a number of other companies failed e.g. ADWORKS MARKETING LTD, AUTO FAIRS UK LIMITED, BULLION EXCHANGE SERVICES LIMITED, STARK FINANCIAL LTD, UK PARKING COMPANIES LIMITED. There was also a run in with the Advertising Standards Authority too.

    Strangely Cascade has a second string to its bow which according to the Information Commissioner is as a "PPI RECLAIM EXPERT".
    Given the multi-talented Mr Busch is known to send out-of-time paperwork it is best to check and if there is no Keeper Liability, then complain to Trading Standards and the DVLA. Perhaps he is just "forgetful".
    Despite being an expert in many areas of business the company was dissolved on 22/12/15 because a "forgetful" Director/Owner Mohammed Habib Buksh forgot to fill out the paperwork. Company reinstated on 13/01/16 and joined the IPC on 28/01/16. Genius!

    That's very handy to know. Must be a Jack of all trades.
    It does say front and back of the letter that there is keeper liability and that they will take her to court

    Cascade Financial Ltd accounts are nearly 3 months overdue and Companies House have applied to have them struck off; though the process was suspended on 21st May. The chances of them going to court, (as a claimant), are very slim.
