To Whom It May Concern.
Please accept this as my defence in the claim brought against myself by UK Parking Control Ltd.
The claim relates to a parking charge for parking on the pavement outside of the ‘Edgbaston Mill’ which is a residential complex.
The ticket was issued on the 24th April 2015, this was the day I had moved into a first floor apartment at the premises.
The site offers a small amount of parking outside the complex of which all were occupied at the time I arrived with a vehicle full of furniture. Given that there is no other parking in the vicinity I parked on the pavement briefly to unload the furniture, whilst carrying some furniture into the apartment I noticed someone who I now know as an employee of UKPC by my vehicle. I lent over the balcony to explain I was moving in and that I was coming down to move the vehicle, this was acknowledged and I was given the response “yeah no worries”.
I then walked down the stairs and back towards my vehicle only to see the individual placing a ticket on the vehicle, when questioned about this he just walked off.
Following this event I awaited correspondence from the company with regards to the above, this arrived a month or so after this date. I subsequently sent a response via recorded delivery stating my appeal to which I had no response or acknowledgement. I in fact heard nothing from UKPC until I received the county claim form detailed their intended action against me.
At no point has UKPC attempted to mitigate their apparent financial loss, I use the word apparent as the actual ‘Contract’ they claim is for the marked spaces of which no charge is requested and is merely a two hour time frame.
Therefore, as there is no ‘Contract’ for a ‘Forbidden Act’, how can I be in breach of this. This together with the deceitful conduct of the employee at the time the ticket was issued and the lack of response from UKPC when contacted by myself is disgusting.
It can only be seen as another attempt by UKPC to bully an individual, further adding to their known unprofessional reputation and unlawful practices, as highlighted in many well-known cases such as their suspension from the DVLA.
I look forward to receiving a response to my above defence.0 -

That defence is terrible. What is the exact "offence" alleged by UKPC, how near are the nearest signs, and what exactly do they say? Pictures please.
I realise you don't have much time but that's your fault for disappearing for a couple of weeks. You need to pull your finger out now.

Dazster.. the exact offence is "breaching the contract by parking on the pavement". I'll have to grab a picture later this evening after work.
I'm aware of the situation, being on holiday whilst this was being processed is just one of those things with the tight deadlines.
I had contacted UKPC last year as I stated in the defence but they didn't respond, when I queried the lawyers on this they stated it was received outside of their deadlines and was subsequently void etc.0
