    Ignore the fact you work BH or any other day, all work days are the same.

    What you do is work out how many days you are entitled to as paid holiday.

    4-4 is a 3.5 day week so you pro rata the holidays the full timers get

    In your case a standard full time worker gets 28 days + BH normally 8 but this year 6.

    so you are entitled to 19.6 days + 4.2 days.


    If in previous years you have been getting All BH(with sub days if you worked one ) or just sub days for the BH you worked then that was wrong.

    No we have two columns one giving annual leave and the other giving Public holidays....
    As I mentioned earlier if we work a bank holiday we get paid 12 hours and can then take that holiday we have just worked later in the year so we should get paid what we get paid if we work it.

    Now you are arguing with the wrong person,

    I have explained how they may have concluded your legal entitlement for the BH and it is in broad agreement that they have about the right amount of hours for a 4-4 shift pattern.

    if you don't agree with this take it up with your employer to explain how and why you are allocated 50ish hours to cover the BH that you may or may not work

    If you only want extra holiday for the BH you work and they roster you to work no BH so you get no pay fine.

    Receiving 19.6 days Annual holiday is correct as per the gov website, They can't apply the same criteria to bank holidays as bank holidays are holiday given with set day/hours, as I said we do get 8 bank holidays on top of our annual holidays and have always done except for last year where we got 10 bank holidays because Good Friday and Easter Monday fell prior to our annual allocation 1st April to 31st March, this year only 6 bank holidays were given because of the afore mentioned, I assume it will revert back to 8 bank holidays next year.

    If we work a bank holiday we get it off at a later date, if we are off shift when a bank holiday occurs then again we take it at a later date. ACAS state if we work it then take it off at a later date they must pay us the same amount of hours, if we are not rota'd in to work then they must still pay us for 12 hours because that's what we get paid if we work it.

    Just another note, if we are off sick we get paid 12 hours for each day we are off sick, so why would they only pay us 8.4 hours for each public holiday.

    I was hoping that someone else that worked the same pattern would let me know how they are paid for public holidays.

    My query is being investigated, by the union and our HR department.

    We work 4 on 4 off over an 8 day period. 42.11 hours per week which is is full time and is over 4 hours more than day shift work. My contract actually states 22.4 days annual leave and 8 days bank/public holidays, it's only recently they now state 19.6 days, I was never notified of any change and from what I can gather both party's have to agree to any changes to a contract, but this is another issue which will be dealt with separately.

    4-4 is 3.5 days a week that's what's used to work out the holidays prorata

    The change to both are probably to bring your holiday in line with legislation.
    Same issue not different ones.
