4 on 4 off Shift Pattern

Can anyone help...
We work 4 on 4 off 12 hour shifts, we get paid for our lunch breaks and get 19.6 days annual holiday, how would you work out how many public/bank holidays we receive? we have been told instead of getting 6 day's public holiday's for 2016/17 they have calculated it as 50.53 hours which works out at 4 days 2 hours and 53 minutes, is this correct, should we not get 6 days @ 12 hours and if not why not.

You are entitled to 19.6 days holiday per year and this can include bank holidays. If you want a bank holiday off the I would think that you would have to book it out out your 19.6 allocation.

I disagree. The OP's hours work out at 2190 per year, the statutory leave allowance for that is 264 hours 18 minutes, which is 22 days 18 minutes of 12 hour days. If the company is only allowing the OP 19.6 days including public holidays then that is below the minimum, if public holidays are additional then as long as the total is no less than 22 days 18 minutes then it's within the statutory minimum, although without knowing what the contract of employment says it's impossible to know whether that is adhered to.

The op works an average 3.5 day week, 3.5/5ths of the legal min of 28 days is 19,6 days.

Take it up with the government then, I'm just telling you what their calculator says.

Your mistake was using annualised hours in the calculation, the op won't be working 42 hours a week for 52 weeks as they will be on holiday for 5.6 weeks.

Yes, you're right, although I'm still slightly puzzled why the difference exists in the calculations as I thought leave was still accrued while you are taking it.

In practice the way the calculations are done by most places it looks like you do, but you don't

Most places get it wrong when they pro-rata

eg if you work 6 month(26 weeks) and leave they give you 1/2 the holiday 14days(2.8 weeks) but you are due more because you only need to work 23.2 weeks to earn the 2.8 weeks holiday.

Ok just to clarify, we do get 19.6 day per year annual leave and we also get in addition bank/public holidays, (normally 8 per year) this year its 6 and last year it was 10 because good Friday/Easter Monday fell outside our leave year of 31st March to 1st April, the issue is should we get paid each public holiday what our normal working day is i.e. 12 hours
If we work a bank holiday we get paid 12 hours, so if we take a bank holiday off or are not rota'd in to work it, should we get paid what we would normally get paid when we work it.
