    Since the bank hols are given over and above the legal minimum it depends on your contract, it is up to your employer how you get them.

    My understanding is if you get paid 12 hours for working a bank holiday then you must get 12 hours for that holiday when you then take it off (in lieu) and the same apply's even if you are not rota'd to work it you would then get 12 hours as thats what you would normally get paid for working a bank holiday.

    Dayshift workers who only work 8.5 hours get paid 7.5 hours for each public holiday which is 8.5 less their lunch break = 7.5 hours, we surely should not be treated differently.

    The companies with X + BH holiday allowances and April-March holiday years are messed up because the have not kept up with the legislation

    As yours are X + BH and X is sufficient to cover the statutory minimum they can vary the BH to match the current year.

    This year there are 6 BH and you work 3.5/5 so are entitled to 4.2 at your normal daily rate pro rata if standard 5 day full timers get the 6 days.

    12*4.2 = 50.4 hrs.

    Yes normal full time day shift get 28 days + bank holiday's (normally 8) but last year it was 10 and this year its 6.

    I take it you are in the security industry and have to cover ever night including bank hols if that fall on your shift?

    If I work a bank holiday, which I do (if I am rota'd in to work) I get 12 hours pay + the chance to take that public holiday at a later date, so if they pay my the full 12 hours for working it, they must also pay me exactly the same if and when I take it as a holiday.

    Where do you get your calculations from.

    Ignore the fact you work BH or any other day, all work days are the same.

    What you do is work out how many days you are entitled to as paid holiday.

    4-4 is a 3.5 day week so you pro rata the holidays the full timers get

    In your case a standard full time worker gets 28 days + BH normally 8 but this year 6.

    so you are entitled to 19.6 days + 4.2 days.


    If in previous years you have been getting All BH(with sub days if you worked one ) or just sub days for the BH you worked then that was wrong.

    No not in security, just work in IT doing things that can't be done during day shift, running batches etc.
