Car parking damage disclaimers

Hi, I parked in the meadowhall car park the other day and my rear window was smashed. There was no CCTV and meadowhall said they would let me know if any one reports anything, they do have a disclaimer notice up but surely they are responsible for ensuring my cars safety. I have to pay a £75 excess which is technically meadowhalls fault for not doing rounds in the car park. Does anyone have any advice on what i can do, whether i can get them to pay the £75 as i have no idea what to do.
Thanks,
Katy
Thanks,
Katy

How is it their fault?
If they are negligent they are liable for damage but until you can prove they are you pay.0 -
I would say its their fault because shouldn't they patrol their car park , and surely they should have CCTV to prevent any damage. I see this as negligence not having CCTV and not patrolling. My car was parked for 8 hours and i have no idea what time this happened. But how would i prove negligence and do you think this is negligence ??? Like i said im not sure.
Thanks0 -

Could be a fault with the glass.
DM exits stage left and another new user has a problem.0 -
The way it was damaged shows that it wasn't the glass. It had a huge hole where some glass had fallen through glass was on the floor scattered and all of the back windscreen has been shattered. I doubt how it could be a 'glass problem'. Do you think that i could prove negligance and how would i go about doing so ??0

You're being extremely rude, I'm in here to get advice about my problem not to get attitude. All I'm trying to imply is that because the car park wasn't monitored by not having CCTV and not being patrolled effectively doesn't this collate to being negligent ???0

12,00 spaces & they are meant to watch everyone of them either by CCTV or by human patrols. ?
Do you think that is a realistic expectation from a free car park.
For the service that you seem to want the cost would massive in CCTV costs to cover all angles & record. The wage bill would be through the roof for security.
I think overall Meadowhall is a pretty safe place to park given the technology that is available on site.

Aka not telling you what you want to hear. :rotfl:
Has the lack of cctv or a security guard not spotting it before you damaged the window? No.
No negligence. Time to move on.0 -
Thankyou, i see where you're coming from and it would have a big budget attached. However do you think they have been negligent by not installing CCTV or having patrols ?0
