Giving Tenant correct notice. What should it be?

We have a tenant in our house and she has a 6 month tenancy agreement running from 1st April to 1st October.

Unfortunately for the tenant we need to give her notice and move back into the house ourselves, however we are at the moment unsure of an exact date.

If we required the house back on the 1st October when would we need to give the tenant notice by ?

If it was to be after the 1st October what notice would we have to give then.

Many thanks

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?

Did you serve a S8 ground 1 notice before the tenancy started? (http://www.legislation.gov.uk/ukpga/1988/50/schedule/2)

If not, S21 Notice with 2 calender months, using the
    New S21 Notice (Form 6a)

If you don't know it's probably good that you're not going to be a LL for much longer. Read G_M's guide to ending a tenancy:

Thanks for that, Ive never claimed to be a landlord, just a victim of circumstances.

So, correct me if Im wrong....

To end the tenancy on the 1st Oct I need to serve a section 21 which ends on the 2nd october?

If the tenancy rolls over into the next month making it a periodic then does it drop to one months notice ?

Victim of circumstances my foot. You chose to let the property ergo you chose to be a landlord.

Are you sure the fixed term ends 1st October as that would 6 months + 1 day.

read GM's guide (and read it in full this time!)

are you sure the tenancy is 1st to 1st as that is 6 months + 1 day - somewhat unusual!

I'm continually perplexed why people claim this on here.

Im sorry but you know nothing about me or my circumstances what so ever.

Im serving military and we were living in the house quite happily until I was posted to Scotland which is a 10 hour trip from where the house is and I didnt want my kids to grow up only seeing their dad every other weekend if they stayed in our house and I lived in the block in Scotland.

So rather than sell the house that we want to live in long term we have let it to a family member.

Thanks for your input though, most helpful

Well then you will have provided tenant with an address for the "serving of notices" in England or Wales or no rent is due.

Your personal circumstances do not - weird eh? - change the law. Did you or did you not serve prior g1 notice?

Living 10 hrs away from property does not give you extra privileges. Nor me, 10 hours away from home camping in the Highlands trying to rent the place out.

I do not go on about being an alleged "accidental landlord":. I dug my own hole, my decision, my problem. And me a pacifist.

    Sainte mhath.

PS. Never, ever, rent to family or friends. Only ever rent to those you are happy to evict in the full glare of local papers & TV.

Im not asking for extra privileges at all just explaining how I became a landlord of sorts.

Can you tell me what a G1 is please?
