Supreme Court Ruling Scotland

Hi there,
Apologies if this is covered elsewhere, I have had a look and couldn't see the info I'm looking for.
I've had a notice of fine for the Crow Road car park in Glasgow. I've now had a letter from DRP Debt Recovery threatening court action on the basis of the Supreme Court Ruling of ParkingEye v Beavis Nov 2015.
Does this affect me in Scotland?

Have you contacted the private parking company in any way, shape or form?

If not, continue to completely ignore. DRP have no teeth.

Keeper liability does not apply in Scotland. If the PPC do not know who the driver is, they have no-one to chase for the charge. And no one is going to tell them who the driver is, are they?!!

Thats why you ignore in Scotland. And why the Beavis ruling is moot in Scotland

It would depend entirely upon the circumstances of the alleged parking event, and could even work in your favour.

However, the advice in Scotland is to ignore private parking tickets as the law regarding keeper liability does not exist in Scotland. Only the driver can be held liable therefore if you don't tell them who was driving they are stuffed.

All this is explained in the Sticky thread for NEWBIES, as is the information telling you why it is safe to ignore debt collectors anywhere in the UK.

By the way, you have not received a fine. It will not mention that word anywhere on your paperwork.

If you were not the driver drop me a PM.

  • Thank you. I haven't contacted them, as per advice, but the letter is quite harsh and they managed to spook me, hence the post.

That's exactly the point of it. If you think it's threatening or misleading, then you should be complaining to Trading Standards.
  • Hi, how did this pan out? I am in a similar position, and just wet myself opening the first contact from DRP!:( thanks

normally speaking people only come back if they get court papers , in this case and all ther other cases on here and pepopoo that are for scotland , the OPs never return , that to me looks like the debt collectors letters fizzled out ,

did you wet yourself with laughter , another way of doing this (wet yourself laughing) is to look at the names and addresses at the bottom of all the scary letters , example DRP = oh yes , zenith

You are asking how ignoring debt collectors in the whole of the UK, and ignoring private parking companies in Scotland is panning out?

Er, I think the original poster is still ignoring them.

Have a read of the Sticky thread for NEWBIES about private parking tickets in Scotland and NI, and about toothless, powerless debt collectors over the whole country if you need reassurance.
