Time for a complaint to your MP? Post on Twitter and Facebook about it (if POPLA have such accounts)?
Probably best to otherwise let this drop, and if the PPC dares to file a claim you can use this in your evidence that the keeper is not liable.0 -
Another flawed decision from PoPLA. ,You never know how far you can go until you go too far.0

Dear XXX
Thank you for contacting POPLA.
While I fully understand that it is disappointing and even frustrating when an appeal results in an outcome that you were not hoping for, our role as an impartial appeals service means that quite simply, we must base our decisions upon the factual evidence presented to us. I am satisfied that this has been done in your appeal and there will be no change to the outcome of our decision.
POPLA’s role in your appeal has now ended. As such, any future correspondence you may send to us will be added to your case but we will not respond.

I honestly don't understand how with all the evidence presented to them that they can just say that they won't change their decision on this case. This is just ridiculous now!
POPLA have been making dreadful decisions of late, they clearly have no understanding on many aspects.
If this goes to court and you win on your points, that is the time to rub the noses of POPLA in the mud .... which will happen.
It would also be the time to question the validity of this new POPLA0 -

You must report this to Nicola Mullany of ISPA. She is a former solicitor, so should understand the law in regard to Keeper Liability. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It's more than that. She sat on the board of of the Leasehold Advisory Service so knows more than most about this.

I don't see why Mr Gallagher never responded since it was explicitly addressed to him?
Good luck OP0 -
I thought I would give a quick update to this story. I spoke with the Housing Association about getting the fine cancelled and after a month of back and forth emails via the Resolver website the verdict originally was that the fine was being upheld and I had to pay. I asked them to provide proof of them tell me of the new permit being ready for collect and due to lack of evidence of them tell me about the new permit being issued (because they never did tell me) they have now agreed 5 months later that the fault lies with them to pay the fine or get it cancelled.
VICTORY!!!
Thank you all for your amazing help and advice! I have learnt some valuable lessons on here from you all.0 -
Yay! Well done to you and for getting further help from the Resolver website too - a consumer victory.
There is one final next step:

DO THAT!
Let your MP and Mrs May hear about how this awful threat affected you - how the BPA's flagship 'appeals provider' of POPLA failed you - and what you think about the rotten greedy 'parking industry'! Write your own or use the template provided by the BMPA.
Show them the rubbish you have received and ask why the Government thinks it is OK for consumers to be 'credit clamped' with a threat of court for SIX YEARS by this rotten industry of money-grabbers and ex-clampers? You only managed to extricate yourself with a level of 'never give up' determination over several months that many people would have failed to achieve even for a minute.
On that linked thread, HO87 has just posted pointing out the stranglehold Capita has over this issue (which is all about money). But suggesting that the only answer - if the Government dare - is for PPCs to be banned like clamping was, and for S56 of the POFA 2012 (that led to Schedule 4, keeper liability for these parasites) to be repealed.
I agree. This rotten industry were never worthy of having keeper's data from the DVLA but especially not the right to hold keepers to ransom for six years for an event that they may not even recall/may not have been driving and in any case, is always unfair and nothing more than a protection racket operated by ex-clampers.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
