Fined while parked in my own bay

I have received a PCN from P4Parking asking me to pay £60 by 31/05/16 after unsuccessfully appealing to them about a permit not being on display.

I rent a bay in a residents only gated underground car park where I live in SE London. I pay £40 a month to do so. On 6/5/16 I came down to my car to see I had been issued with a PCN. They said my permit was not on display, this is despite being parked in my assigned bay in the car park. The permit is a flimsy paper disk that has lost its stick so we have now resorted to just leaving it on the dashboard. We found the disk on the floor of the car where it must have slid off. Simple mistake. I don't use my car everyday so I wouldn't have noticed the permit not sitting in its normal space until I next came to use the car. We had asked to be issued with new permit as the current one isn't fit for purpose, only today have they agreed to give us a new permit but they have said we still need to pay the fine.

Can anyone offer me advice on what to do next. I feel so f'd off with the situation! I can't believe I am being fined for being parked in my own bay, surely the company should have a record of all the registrations of the cars and their assigned bays before they go around handing out fines.

    1. Complain to the management company and demand that they get this cancelled.

    2. Dig out your leasehold or other agreement by which you rent the parking bay and tell us what it says (especially if it says anything about permits, or not).

    Chances are, since you are paying for the use of this bay, you are its lawful, and exclusive occupier and you can tell both the management company and P4P to FRO lest they want to be sued for trespassing on your space.

  • They took a picture of the sign in the car park but it is out of date as it says you need to display a clear, valid tax disk as one of the reasons why you could be fined.

    P4Parking are BPA members so you should appeal around day 26 online or day 22 by post using the BPA template in blue you will find in the Sticky thread for NEWBIES.

    Don't appeal too early but don't miss the appeal deadline either. Simply copy and paste the template. That's it, stage 1 done.

    Meanwhile read your lease as advised and tell us what it says about parking permits. In addition take a picture of all parking signs including the entrance and post them here. Upload the images to a web hosting site such as Tinypic or Photobucket then post the URL here but change http to hxxp. Someone here will then change it back to a live link.

    I would suggest it is not a valid image of the sign on the day then. Clearly a sign that says that could not have been current to May 2016. Perhaps they are sending in false evidence.

    You should check the current signage and see if their photo is current. I would not be surprised if it is the current version as the PPCs are quick to put up signs but slow to update them with current legislation. We have some reports of some signs still threatening clamping.
  • I checked the sign last night and it clearly states that you can be issued with a PCN for not displaying a valid tax disc. Also I noticed the sign said I would be paying up to £100 or £65 if paid within 14 days. On my fine it says £60 which is a bit misleading, sure it is only a £5 difference but still! Also the sign is not near my car, all I have near my car is a different sign saying "SHG Parking Bays, no unauthorised parking" No mention there of anything to do with a valid permit. Should I mention these facts when I appeal to POPLA?

    PS £65 is not a 40% discount on £100 , the signage does not meet BPA guidelines

    I checked the sign last night and it clearly states that you can be issued with a PCN for not displaying a valid tax disc.

    P4Parking are clearly stupid ..... the DVLA no longer supply tax discs

    Are you sure they say "tax disc" ?
