Family member sent the wrong TV

I posted this in the wrong place earlier.....so re posting here.
Looking for a little bit of advice here, a family member ordered a Tv from her catalogue, paid £300 for a 40" cheap brand TV (interest free over a year), she asked me yesterday to come over and set it up as they are useless at techy stuff, so i set it all up, binned the boxes and took her old TV to the tip for her.
Then tonight, i looked online for her TV and realised that the tv she had was a samsung UHD curved screen thing costing £500, not the cheapo luxor costing £300.
she now informs me she is paying extra for warranty, im now wondering what to do, as if we keep the Tv, really she wont have a 1 year garuntee, never mind an extended warranty.
What should we do?, phone them and ask for the correct TV?, or what?
If it was me, id just keep it, but the family member will have problems should it malfunction, and will render the extended waranty useless.

You have received a higher specification TV than ordered. Of course, any warranty will not apply to this set.
You either keep the higher priced model without warranty or you inform the retailer that you've been sent the wrong set..
Your choice, but neither technical nor consumer.
Personally, I'd just be grateful to receive a TV worth £200 more than I paid.
A far better TV for a bargain price.

From memory warranty can be cancelled for a full refund if it's within 45 days of purchase?0

As I said in other other thread, if they swap it, the retailer would (I think) owe your family member compensation for the extra time off required for a redelivery, because it was their mistake.
So I'd ring them, and negotiate with them on whether they swap it (and hence pay compensation for the extra time off required, caused by their mistake) or leave the TV where it is and change the warranty over.0 -

Why wouldn't the same apply if the OP had to take an extra day off in this scenario?If your delivery's delayed and you have to take extra time off work to await redelivery, it's possible to get compensation. Of course, we're not talking about when you stay in hoping the delivery may turn up, but when a delivery or installation's been booked for a certain day - and you've arranged to be in specifically to receive it.
While your legal rights can only truly be enforced in court, just knowing and quoting them boosts your chance of success. It's also possible to get compensation for additional costs and even the inconvenience and distress caused by late delivery problems.
And the point is that they could use this to negotiate.0 -

Yes, but it wouldn't be anywhere near £200 so depending on the family members outlook they would end up worse off.
OP, if it's just the warranty that your family member is concerned about, they can purchase one for the correct TV from a 3rd party (a quick google suggests quite a few companies doing this) and cancel the old one with the retailer. It will cost less than £200.0 -
Why did you set it up and throw away the packaging? You obviously knew it was the wrong/better TV that was delivered. I've seen Samsung curved UHD boxes and it says Samsung UHD Curved in massive writing over the front of the box. I even just googled Samsung UHD Curved box and it brings up quite a few pictures of what they look like. The is no way to mistake it for a cheap Luxor.
So the title of your thread should be I knew I had been sent the wrong/better TV but set it up and threw away the packaging anyway hoping I could get away with it.0 -
Bear in mind that it wasn't the OP who bought the TV, OP simply unpacked it and set it up.

I'm always suspicious of topics like these, along with those that involve money being given in error, or not taken on time. It's amazing that people only seem to notice the problem when they spot a potential negative issue for them. I wish people were more honest and just admitted they were hoping they'd get away with it.
Anyway, the company could potentially ask for the TV back and on the basis it was clearly a different TV and you've now set it up and disposed of everything they could ask for the difference in price. The time to contact them was when you first received it.0
