Possible fraud by my mother/brother with a Mobility car

If she can't make decisions like this on her own perhaps you should look into getting some kind of protection for her, like a power of attorney.Changing the world, one sarcastic comment at a time.0

He was banned some years ago so had to do the 'advanced' driving test or whatever it is they call it - if he was banned in the last 10 years would this be a potential stumbling block for someone using this scheme?
I'm not aware if Motability know he was banned - I just presumed that they would get this info from background checks etc.. He has a valid license now however just to clarify.
If he's had to do an extended test it suggests he's been disqualified for dangerous driving.0 -

According to the other thread running elsewhere on the forum, he's been in prison for 8 years!

Over the many the years the 'ferrying round' you referred to was done by mainly myself and my sister. At no point was this as problem as I live very close to my mother and we are a close-knit family so it is fine.
I am guessing the reason he does not want to declare his real address for insurance purposes is because he clearly has something to hide!0 -
I'm guessing your brother is also using your Mum's disabled badge to park wherever he wants when your mum is not with him0

Where is the car kept for the most part of the week .
Who paid the rather significant upfront non refundable payment to go to this class of vehicle ?
Personally i would phone Motability and report your concerns they are very helpful .0 -
I have just been looking at the Motability website, where your brother would no doubt fall foul is this:
Use of your car
Before you can lease a car on the Motability Scheme, you’ll need to make sure you’re happy to lease a car within the Scheme’s terms and conditions.
We’ll ask you to make sure:
· The car is used by, or for the benefit of, the disabled person. This does not mean that the disabled person needs to be in the car for every journey. In practice, this means other named drivers in the household can use the car for shopping and other routine activities, as long as the disabled customer will benefit
· Only named drivers listed on your Certificate of Motor Insurance can drive the car*
· That you let us know about any changes that may affect your lease.
* We will only accept drivers who have a legally valid driving licence. Drivers with a non-UK driving licence will be subject to additional checks.
At the time of ordering your new car , you, your nominated drivers and the Motability dealer will need to sign a Statement of Responsibilities Will download a resource(PDF 467KB) to confirm you understand and agree to follow the terms and conditions for using your Motability car.
Misuse would include:
·Not giving the disabled person the benefit of the car
· Driving whilst uninsured or banned · Using the car in a criminal act
· Lending, sub-leasing or selling the car
· Using the car for unauthorised business purposes, for example, as a taxi or delivery vehicle
· Not taking proper care of your car
Protecting the Scheme
If your car is misused
When we are given information about misuse, we always investigate. If we find serious misuse or severe damage we will take action:
· Your agreement may be cancelled
· You may not be able to get another Motability car
· We may send you the bill for any repairs or estimated loss in sale value.
Reporting misuse
If you are concerned that someone is misusing any Motability vehicle, please use our contact form to report the issue

Looks like i am the only one with this opinion so far...but to me it looks like you are jealous or annoyed that your brother gets to drive around in a Mercedes and you don't think it's fair.0

I really feel you should discuss your concerns with Motability. I know they will be bound by confidentiality rules, but I don't see why they shouldn't listen to what you have to say, then take it from there, leaving you out of it.
