querying PCN & Notice to Keeper

    Stick to the template which clearly says it suits every case. Why on earth do you think it's your job to look at the signs? No, you DO NOT put that 'the penalty seems excessive'. If that was the advice it would be in the template...

    Many thanks for your responses Ralph-y and CP, I will take your good advice and use the template as it is. Interestingly one of my son's flatmates has had a few PCNs from the same Euro car park, he ignores them and they stop after a letter or two. It's a pain to get a penalty but fascinating to read all the info on tackling them.

    A small point- my @blueyonder.co.uk email account will show my name in full. Would I be better sending the template letter response to Euro from an alternative email account that does not show my name?

    they have upto 6 yrs to continue , often people move house , a letters arrive yrs later , are not answered and a default CC judgement is given , causing problems with credit at a later date

    he might get away with it for that car park ... he might not ......

    but trying the same ignore else where with a different PPC could land him in court, or with a CCJ :eek:

    I sent the template letter yesterday by email to Euro Car Parks and they replied straight away as follows-


    "Good Afternoon

    Law of contract applies
    The PCN has been issued correctly for the P&D/permit purchased did not cover the date and time of parking
    Signage is quite clear in its intent

    Due to the Protection of Freedom Act 2012 you are required to offer a serviceable address of the driver – if you fail to do so ECP can through civil action reclaim the cost of the PCN and any associated costs

    I have passed your appeal to the appeals team

    As long as your appeal did include your address as 'keeper' (not just an email address) then your appeal was properly made and ECP are unlikely to respond within 35 days. When followed up they then pretend it was cancelled all along.

    Your son's friend needs to know not to ignore some PPCs, such as ParkingEye who sue people. In England/Wales, it is no longer safe advice to just say that private parking charges can all be ignored. Different in Scotland where people should NEVER appeal but should always complain of course, to retailers/landowners, to stuff the PPCs in the long run.
