    You say your tenant won't answer the door, then there is no point in sending anything to her, she simply won't sign for it. If in Scotland use a Sheriff Officer ( or a baliff ) to give her the required notice, it will cost you around £60 WORTH EVERY PENNY!!

    not everyone who receives housing benefit abuses their child, moves in their alcoholic parent and has wild noisy parties ! :rolleyes:

  • im sure they re not but sometimes it does seem that way. and they re usually the ones who leave a property in a really bad state. we no longer rent property to "dhss" tenants due to the problems we ve had with them

    Yes I agree, but many LLs will take little or NO deposit from tenants on HB just to get the place rented, the tenant therefore has no stake in the property, BAD IDEA !:eek: On the other hand tenants on HB usually stay longer sometimes several years, private paying tenants might stay only 6 months, and still leave a property in a poor state. If I had to turn round every property I own every six months, I would shoot myself in the head.

    There has to be a correlation though, my ex-neighbours from hell were on HB, luckily we rented so could move...

    There are some anti-social patterns and disfunctional lifestyles that are incompatible with holding down a job (being !!!!ed ALL the time and staying up all night and fighting with anything that moved seemed my neighbours genre) and so people who have such tendancies end up on HB... so although only maybe 1 in 40 like that on HB, probably more chance of getting a really bad tenant (even if still small). Plus LLs seem to have issues withthe payment system and if want to terminate tenancy HB tenants have less options (fewer LLs prepared to take, don't have deposit, told to wait to be evicted to move up council list) so often has to go to costly eviction process so although statistically the risk is only slightly higher the consequences are so costly they want to minimise it...

    Don't even think about "I want to live in the property myself" as your grounds for eviction.

    This will not succeed in court unless you do not own any other property that you can live in. In fact if it was ever discovered by the judge that you had infact sold the current property that you live in solely for the purpose of gaining possession of your second property you could well end up in deep and expensive s##t!

    Wait until 2 month before the end of the tenancy. Then give the tenant 2 months Section 21 notice. then apply for your order for possession. Then if needs be, apply for bailiffs to evict her. This should all take 3.5 to 4 months from the date of giving notice. Or, as I said previously, apply for possession on the grounds of 8 weeks or more rent owing which might be a little faster.

    Even although you have a signed tenancy agreement stating the the period of the tenancy together with the required notice period the simple facts are that if your tenant does not leave at the end of the notice period you still MUST get a court order for possession.

    Start the "legal" possession process as soon as possible - but make sure that YOU GET EVERYTHING RIGHT - OR YOUR CLAIM WILL NOT SUCCEED!!!
  • Again thanks to every one for their posts, checked ast and expires 25.11.07 (so have leaway to do 2 months notice, again) I rent to both those on Hb and private and have found those on HB to be usually better tenants, longer tenants and easier tenants, Infact I prefer Hb to private, as they usually know this is their home, not just a rented house. Private are always seem to want to leave after a year, which is hassle. We do informal checks as usally rent by word of mouth, and know of tenant prior to them renting from us, and to be honest this tenant was brill til last Dec, But its a business and arrears are arrears, and we are currently selling house to try and move into this one, (Partly so hubby can retire due to ill health)

    Saving like mad,

    I think you need to issue a section 21 notice to her asap giving the 2 months notice. I have no idea what needs to be in a section 21 (and from your other posts I suspect that you don't either, sorry if that sounds rude but going on about not renewing tenancy agreement is different to you must leave the property by xyz date.) so you need to look that up.

    You then need to make sure she receives the notice. I think if it was me I'd send it special delivery, maybe in a big parcel so it looks inviting and put the return address as a friend so that she doesn't refuse to sign for it. Also I'd send one with just a 1st class stamp with proof of postage as this should be enough to convince a judge that she had received the notice.
