how to get evict easily

  • what does accelerated procedure mean, i know what accelerated means, but in court terms as courts say they wont even hear the case before mid Oct, but her 6 month tenancy renews start Nov, so surely that would be easier, (cheaper and more likely) she has no chance of paying arrears and as council say they are only going to give her £50 per week she has no way of ever paying that, and no she does not have mental health problems. Child abuse was either from her her partner at time(of which there have been many) or visiter to house. but very severe and im sorry but I'm a mum too and the state the child was in was recognised by several people when she took child into the pub, which i guess says it all! she has wits to keep door closed when we call round neighbours tell us. Or if police call.

    You'd have to be pretty stupid to get caught. If someone is willing to go to the police, you obviously didn't hit them hard enough, so the second attempt needs to be better. One of the advtages of having to wait weeks for a trial, is that you have time to persuade them to change the way things happened and confess they made it all up.

    Scum only understand when it's being beaten into them!

    I hope you're not serious, because if you are, I have to say that your attitude is absolutely disgusting. I agree that it is completely unacceptable and wrong to harm a child BUT two wrongs do not make a right.

    how do you know whether she has got mental health problems or not?

    YOu are a landlord- at the end of the day, you can only do what is in your remit. which is either
    a) allow her ton continue living there
    b) you evict her.

    I cant see what her behaviour has actualy got to do with you. the authorities are involved , let them do thier job and you do yours.

  • hi just spoke to a solicitor and he says both applying for eviction on arrears and other option of waiting for end of tenancy need court orders regardless, both long winded, feel at moment like just changing the locks and putting stuff on street, no bats or kickings very frustrated. Have applied to court for papers to serve for arrears as he says at moment that is quicker option.
  • actually her actions are to do with me, if she causes a nuisence to her neighbours I am held responsible by law see forum noisy nieghbours, if I allow other people to live in the house, she is in breach of her tenancy and under the housing act circumstances. Under mental health no i am not a doctor, but live in a small town, in which every body knows everybody and know her day to day living would not be classed as mental health, And feel all are losing track of what i am trying to say, what do I do for easiest way to evict given the circumstances,
  • have put everything required in the section 21 in the letter and have had it sent registered so what have i done wrong, I told her prior to sending her letter out of common decency, to inform her, also to try and prompt her to find something else, i think many poeple her who have had notice served would have appreciated knowing prior to the two months legal requirement.

    Oh really? Lets play devil's advocate:
    1. Tenant turns up in A&E with severe wounds. Candidates are Boyfriend, Mother or Landlord. Pick which one tenant is most likely to finger.
    2. Landlord has been calling round giving tenant grief about mother, parties, doesn't like boyfriend etc. and wants tenant out.
    3. Police will most likely be involved already due to child being taken into care, so can't be seen to treat any related incident without priority.
    4. You don't know mental health of tenant, Police can ask questions you can't.

    If you didn't make a good job of beating them up then you will only get charged with something like GBH or aggravated ABH. If they are in a worse state you'd be looking at attempted murder. All IMHO. Then start thinking about the civil case for damages from them, after all they'll qualify for legal aid or get a no-win no-fee deal because the case will be a "slam-dunk", as the yanks say, after the criminal conviction.

  • dated the letter at day written 31.8.07 gave notice from that date that tenancy would not be re newed at end of tenancy which (from memory) as letter not here with me 5.11.07 therfore giving her 2 months notice

    Easy this landlording business, isn't it? I take it you took action because of her breaches of the tenancy agreement? Hopefully it is all legal and documented and not along the lines of some other posts on this thread.

    You just contradicted yourself in there.
    The easiest way is a S21 notice. Post the details so we can see if they were correct otherwise you will have to issue another one with the correct dates and wait longer.
