DWP sending DLA file over when passporting to PIP

This morning I wrote a reply to my initial complaint escalating it to the director general, wrote a complaint to the DWP re. the lack of DLA file, wrote a complaint to the NMC enclosing a copy of their nurses medically inaccurate report and received a letter advising me of my tribunal date.
It's cutting it fine for the arrival of the medical records which should be here by the end of the month0 -
Have tried to keep up to date with your 'journey' so forgive me if I have anything wrong.
You asked for your DLA file to be used for your PIP application but this wasn't done. (Did you have any other medical evidence that you sent with your PIP application or were you relying on the DLA file?)
If you had no other medical evidence then I can understand (in a way) how your PIP application was refused.
I am wondering whether you have time to make a Subject access request to the DWP?

This would help with your complaints and, if in time - they have 40 days - you could produce the records at the tribunal.
It seems to me that the PIP decision might have been made in the absence of any medical evidence and therefore the basis of the compliant hinges on the DWP not complying with your request to forward your DLA file? This request should have been recorded - hence the SAR- and gives you the evidence you need to support your complaint.
The health professional has access to doctors and should have asked for information about your specific conditions. However, without medical evidence it would be difficult to 'gauge' your conditions and how they affect your daily life/mobility.
I am not for one moment trivialising your experiences or condoning what has happened but just trying to get to the root cause of the problem.
I trust the tribunal will reverse the decision and comment on the maladministration of the DWP and the HCP.0 -
I transitioned over Christmas and in the middle of changing cardiologists so was relying on the DLA file, I even wrote that on the application.
ETA don't have time for a SAR though I did ask for the file in my complaint today on the off chance it arrives on time. Tribunal is on 1st June0 -
Well the local health board phoned and told me the records are done and will be available to collect on Monday so I'm going to send my mum over to collect them, we can quickly have a look and copy the bits most relevant for the tribunal and fire them in the post as they need to be at the tribunal for Wednesday.0

So I received the tribunal evidence from the DWP today and was shocked to find that my DLA evidence had not been transferred over to PIP despite me asking for them to do so both by answering "yes" to the person on the initial phone call when asked if I wanted it considered and asking this on the form.
it also wasn't available to the "HCP" on the day of my assessment.
If they're not going to bother doing it why ask if you want it?
The last DLA review was 18 months before the PIP transfer so it's not as if the evidence was out of date!

My doctor doesn't have a website that's open to the public, not even one that I can book an appointment through.
He is on trakcare but it's a sackable offence to look yourself up on the NHS computer system so not going to try that.0
