    I hope you recorded the name and date/time of call. The helpline are not the best at giving correct advice especially about something that is so technical.

    Their guidance manual and the legislation do not seem to match what they have told you. So should anything go wrong in the future, you should keep details of what they have told you (hoping you gave your NINO at the start of the call rather than just a general enquiry).

    There seems to be an inconsistency here.

    The OP has stated that the payments he receives from the PHI are regarded by HMRC as taxable income.

    In effect they are sick pay from the employer as the employer paid the insurance company to provide the benefit?

    If so, how can they not be regarded as income for tax credit purposes?

    Would the OP not be well advised to get a determination in writing?
