What you have described sounds more like just the offering process.

The OP says they DID receive the memorandum of sale!Ageing is a privilege not everyone gets.

We have been looking for a house, found one this week and phoned Haart estate agents.
Our first offer was accepted buy the vendors on Wednesday. Haart then rang round any other interested parties (normal procedure?) and yesterday we were told another offer was now on the table. Therefore they said it went to best and final bids. We increased our offer but got outbid. They had accepted the other offer.
When we were given the news by the agent we were invited to increase our offer. Best and final? We were told the offer but refused to gazump the other buyers.
He only would have phoned the others back to encourage them.
Will be following official complaints procedure but not hopeful that will achieve anything
Very poor and untrustworthy agents. Doubt it's every branch but think twice before dealing with them.
We realise that this is underhand but have they broke any code of conduct?
This happened to me when I was buying. However, I understood that if I was selling my house, then I would want the best possible price. I support what Haart have done here for the vendor. There is nothing underhand at all. If you are not happy then move on. If you really want the house then increase your offer.
I suspect you will soon find out that all estate agents do this. Nothing is legally bound until exchange of contracts. You could be gazumped at the very last minute after you have spent a lot of money and time in legal fees etc.0 -
Gazumping came about down to the craze of messing about with the deposit and contract.
Buyers learned to get your money where your mouth is quickly and it largely died out.
It is however back as the new generation want endless surveys and assurances and then cry and complain when someone walks up who can get things sorted out.
Move on and learn how to pounce on the mouse instead of sitting waiting for it to drop dead.I do Contracts, all day every day.0 -
