Reclaim Packaged Bank Accounts

Hi,

I was wondering if you could all give me some useful hints or tips. Any comments would be greatly appreciated.

From noticing through this website abou reclaiming mis-sold packaged bank accounts, I used the resolver website to formalise my complaint to Barclays.

In 2012, as an 18 year old boy who had not much experience in dealing with banks I was informed by the branch manager to take out mobile phone insurance as it was the cheapest available. I felt as though I was pushed in to taking out the cover. I later returned to the branch to cancel and the same manager told me it was not worth the hassle.

I have today received a letter from Barclays informing me that my complaint has been unsuccessful.

Has anyone had any similar experiences? And what did you do further?

Thanks for your help in advance!

What reasons did they give for rejecting your complaint?
What evidence or information do you have to counter their rejection?

Most packaged account complaints do fail. There is nothing wrong with having a packaged account. So, in that respect, there has to be some failure identified. What is that failure?

You can refer your complaint to the FOS if you think the bank have given the wrong response on the evidence available. However, the last published rate for packaged accounts showed the FOS only overturned 13% of complaints. For any help, we need to know what your complaint was and what evidence is available to support your complaint and what the rejection reason was.

  • Hi thank you for your comments.

The letter from Barclays states that I was issued a welcome pack which detailed the benefits of the pack. It also outlined that I would've had a 14 day cooling off period in which I could've cancelled the pack.

As they have evidence to confirm I was aware of the tech pack and its benefits, along with the signed agreement they are unable to agree that this product was mis-sold.

    That isn't true.

Most packaged account complaints/reclaims have succeeded.

I think you probably meant to say most referrals to the Ombudsman have failed (as most sales are now time barred).
Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

I am trying to reclaim on a package account with my bank.
On the claim form it asks the date I opened the account but I can't remember or find any details of the date. How do I find out the date the account was opened ?.
  • Your reference to the "tech pack" suggests to me that you are trying to make a claim for a fairly recent type of packaged account. I stand to be corrected but I believe their tech, home, travel (etc) packs have not really been around for all that long.

If that is the case, I am not surprised that it failed. Barclays and other banks have been much more careful in the last few years related to their marketing and selling of their more recent products, in order to meet criteria for ensuring customers can clearly assess the suitability of these packages before they sign up. As a barclays customer myself, I can say their materials and literature are pretty explicit now in explaining key facts about the included products and insurances and very clear in asking the customer to review that information in order to confirm they agree that they are suitable.

I suspect Barclays probably are pretty confident their selling practices for these more recent products is pretty water tight.

If you have no documents and cant remember any details how are you going to prove a mss sale.
You have to have paperwork to back up your complaint.
make the most of it, we are only here for the weekend.

The claim form did not ask for any paper work. I have a paperless statement agreement. However, I did manage to find a date when the account was opened.
When I opened the account the also gave me a savings account at the same time for some reason. The savings account gives me yearly statements so a quick look at my online account got me the date..

Ring them and ask them, no-one here will know exactly why - have you made any claims on any of the benefits of the package?

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
