    My appeal has been rejected by Indigo as expected and they say the BPA does not require them to provide a POPLA code for rail offences. The Penalty Notice as well as their reminder letter however still mention a POPLA appeal in the description of the appeal process.

    Is there anything I can do to fight my case other than stump up £124?

    I should add that in the appeal, I did not identify the driver of the car.

    Just because there is no popla doesn’t mean you pay up.

    So it's the end of the road for Indigo, they can't take this any further, only the TOC can do that, and they won't, don't pay them a penny!

    Indigo customer services claims that it was POPLA who announced that they would not hear appeals relating to rail byelaws, as of Sep 15th. Is this true Or was it the BPA who allowed Indigo to do this?

    I think POPLa told the BPA that they did not feel happy doing appeals on railway land , for about 30-6 mths they simply put them on hold , perhaps there inbox was full


    you know the outcome , from your previous case "and says that if I do not do so, then their client may pursue me through Magistrates court by way of a private criminal prosecution.

    How much would a private criminal prosecution cost them? If they were to lose, and you had engaged a Q.C., would they have to pay your legal costs?

    What do you think we all did before POPLA existed?! No-one PAID!

    No-one on any other byelaws/Indigo railway car park thread is paying either. Why on earth do you see this as an option?

    If you unpick this FOI you might get an understanding of how this has mutated. There’s large blocks of redaction to wade through, which no doubt hides some of the real story I suspect.
