Hi Everyone,
I would be very grateful of some advice. My husband and I took our children to the Cinema in Clacton on Sea for the Easter bank holiday. The cinema occupied the same building as Gala Bingo. When we arrived at the cinema, I did notice that it said parking for Gala bingo, which I mentioned to my husband. We obviously had a bit of a communication problem at that point as he got out of the car to investigate but had not seen the sign. He came back and said yeah it s fine the cinema is here! I thought he had checked the parking situation but he had not!! When we came out there was a penalty notice. I phoned the manager of Gala bingo and he said he would see what he could do. However today a notice arrived from UKPC for £100. What should have been a nice treat for the kids has become a nightmare! I have written a letter of appeal saying we never entered into a contract, spoke about trespass i.e. no loss. I said the invoice was punative and unreasonable. My only worry is that there were signs up. The Gala manager said that lots of OAPs could not park in the car park and so there has been a loss although it is only £6.00 to play Bingo on bank holiday but if they won then Gala could have lost!! There were lots of empty spaces when we first arrived but the car park was quite full when we left about 2 and a half hours later. Just hope this does not go to court!! Any advice much appreciated

Sorry to hear that, what made your husband think that the signs said it was the cinema car park ?
You suggest that Gala and the cinema are in the same building.
Clearly the Gala manager did not do anything.
So, forget Gala as you were in the cinema.
Did you retain the tickets/receipt for the cinema ? or any other proof
When you appealed, I hope you referred to the KEEPER of the car and not the driver. UKPC will reject your appeal as they are a cowboy outfit simply wanting your money.
A lot will depend on the signs and whilst you noticed them, are they clear enough for a driver to see them ? It is best to go and take your own pictures and upload to a site like photobucket. Then you can link to here but because you are new, you cannot place the actual link ... the http of the link should be shown here as hxxp and someone will change it so we can see it

It was a stupid communication breakdown between my husband and myself. I noticed the signs, they are high up but quite visible. The signs said parking for Gala customers only. My husband says he misheard me, I thought he had gone off to ask in the cinema if we could use the car park but he just confirmed that the cinema was there but I thought he meant it was fine!! He geinunely did not see the signs so we were talking at cross purposes. We had quite a heated discussion on what happened - both blaming each other which I suppose is pretty unhelpful!! I have not sent my appeal letter now and I will make sure I read the forum and not mention who was driving. Gala Bingo own the car park and building, Century Cinema rent from Gala bingo. It is misleading, if you have time to google images of Century Cinema, you will see that the building has Century Cinema at the top of the building and Gala is underneath. But was it reasonable if there were visible signs?? I will read the blog and look at the ten plate letters thanks so much0 -

Appeal as keeper using the blue writing BPA members appeal template and submit the appeal online to UKPC, NOT by letter. Whilst on their website, click on 'photos' and I think you will find the sign is not shown to be as visible as you think. Bet the terms are unreadable and the £100 in small print buried in a pale, wordy sign.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I did try to appeal on line but I think I went over the characters so it did not go through. Why not by letter? Will look at the BPA members appeal letter. I think the notice penalty has gone up from £60 to £100. I was so cross initially that I complained to GALA and left them the yellow notice. Especially as we are financially quite stretched at the moment so the penalty notice was the last straw! My husband is reg keeper and was driving.

The short blue writing template from the NEWBIES thread nowhere near exceeds the characters on UKPC's appeal page. Try again but be careful and stop if it says the appeal doesn't fit or resets the page for any other reason, because UKPC's norty appeals page auto-resets the drop-down ID to 'driver' when the page resets if there is something missing or the text doesn't fit.
You must make sure it says 'registered keeper' NOT DRIVER before hitting submit, and get a screenshot of the acknowledgment page. It won't cost you a stamp and you will be certain they got it, unlike post.
This is UKPC, do you think they'd be honest and deal with a letter or, is it more likely they might 'lose' them?Why not by letter?

So this is not for you to appeal, he appeals as keeper, or at least you put his name in as keeper (not driver of course). And at POPLA stage the keeper can truthfully say that the driver did NOT see the signs. AT ALL.
The fact you did is irrelevant! You were a passenger and you are not liable and are not the appellant, the keeper is.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Excellent advice, we will try again online. Plenty of time for lengthy letters on appeal and possibly county court!! (fingers crossed it won't go that far). I will put him down as registered keeper and not driver as well as using the blue tenplate as advised. It is up to my husband to appeal but he probably won't get round to it so I am doing it on his behalf! Thanks again.0

I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
I have kept proof of submission of this appeal and look forward to your reply.
