Court Papers, Euro Car Parking/Gladstones

Hi guys, sorry to post again but I hope you can help as can't find anything on web the same as my situation. Basically, in August 2015 I parked on a large empty car park of a closed 99p store whilst I went in wetherspoons (I have done this for years, didnt notice that in the last 6 months the car park had become privately owned and new signs had been put up). I came out a few hours later, to find my car (along with at least 5 others) had the dreaded parking charge notices stuck on windscreen. I appealed as instructed, saying that the signs had been put up recently so I didn't notice, that it was dark and the signs are small and unlit and that I had caused no disruption or loss of earnings for the company by parking on the empty car park of a closed store - but received no acknowledgement or response from the company Euro Parking Services. Due to them not being bothered to even reply I just ignored it and hoped for the best, I then received a Notice to Keeper which I also ignored. Heard nothing for a few months, then a few days ago I received a letter from Gladstones threatening court action and saying I needed to pay £150, I have written to them briefly saying that the information isnt very specific, it doesn't even give a location, just the name of the store and that I appealed in the correct fashion and received no reply. However, I have now received court papers and I need help as I've never had this happen before. I still wish to dispute the claim as signage was not clear and I don't agree with the charge, plus ECP didn't even bother replying to my appeal! I need assistance in what to do with the court process in terms of getting a defence etc.. Thanks in advance!:eek:

    You should change the title of your thread to Euro Parking Services / LBCC as you have not received court papers yet.

    Is you mislead those here how do you expect to get a sensible answer?

    Who does the Gladstone's letter say to pay?

    What was wrong with your thread on this from last week? You got pointed at all the right help and and advice already!

    Search this forum for Gladstones, Miah, and Wright Hassle. All are law firms operating at the very fringes of the law wrt private parking.

    lf Gladstones fail to answer your legitimate concerns, mention Elliot V Loake, or threaten you in any way, report them to the SRA.

    Apologies, I am not great with the forums at the moment, thought that by posting a new thread would have more chance of it being seen that just replying to old one. Anyhow, I HAVE NOW RECEIVED COURT PAPERS, meant to put now not no in my original post (have edited accordingly) I still intend to defend this? On the grounds that no response was made by the PCN Issuer to my appeal, the signage was unclear and the fact no relationship to the landowner etc was given. What do I need to do now? Thanks

    randy101, usually that's correct - but on this board the regulars advise keeping to the thread you started as it keeps everything in one place for both yourself and us.

    Don't panic - perhaps Crabman (the board guide) can merge the 2 threads together?
