Flight Delay Compensation Query

I would like to get your opinion on the following matter.

I am writing in regards to a flight delay that occurred during my journey BHX-DXB-PEW, at the end of 2013. I purchased a return ticket from Emirates in a single transaction which included a through ticket. The journey comprised of first flight from Birmingham to Dubai with a second flight from Dubai to Peshawar. The flight from Dubai to Peshawar was delayed due to technical fault which resulted in us reaching our final destination 225 minutes late. I sent a letter to Emirates who turned down my refund request on the grounds that the late flight was from a non-EU airport to a non-EU destination. I did mention the fact that it was part of the journey which originate in EU (BHX) to no avail. I recently came across an article where I noticed the term ‘through ticket’ – a term I was unfamiliar with hence the reason for my bringing this to your attention.

My scheduled flight length was approximately over 4600 miles, therefore I was seeking €300 per delayed passenger (2 in total) in my party. The total is €600 for all passengers.

    Example: You have a single booking to fly from Manchester to Brazil via New York. A delay in New York means you arrive over three hours late in Brazil. You can claim for this. If however you made the same journey on separate tickets, you would not be covered under EU261 if your flight from New York to Brazil was delayed.

    I read this as a delayed arrival into New York (meaning missed connection possibly)...it is really not clear
    OP does not say if the flight from Birmingham to Dubai was delayed, only that the flight from Dubai...Emirates have been pretty vocal on defending these type of cases in court and winning
    I doubt any of the NWNFs will take on a case where there was no delay from the EU and all the delay was on a non-EU to non-EU leg

    Best to move to the non-EU airlines thread where there are a number of examples of this sort of case (not seen any winners)
