An MOT certificate issued in 2015 would have had the mileages of the last five MOTs printed onto it - did they show the discrepancy?
This is a key question, did the garage show you the MOT? What does it say?
I found my car had lost 100,000 miles after I sold it, blatantly obvious from the MOT history site but wouldn't be obvious looking at car as it was mint.
Remember the saying: if it looks too good to be true it almost certainly is.

Legally the dealer has committed an offence. He is obliged to check the mileage is genuine, ignorance is not a defence.

Even IF you can get someone to enforce that, if the dealer can show he did due diligence in checking and it happened not to show up, nobody is going to prosecute him.

Likewise whether or not its a criminal office, that doesnt change and is not linked with any prospective outcome with this car.

You haven't been 'told off'. You have been offered some very sound advice on how not to be caught out again. And that will also help others who read this thread.

I'm not sure what we can do about how your actions make you feel.

    Have to agree.

how old is the car? £2500 is a reasonable amount to payfor a <7 year old car with 100k on the clock.

Also a clutch job does not necessarily mean the car is a has been. If a car is driven well it can run on the factory clutch 200k miles in. if it's been pratted around then a clutch could die in 5k miles.

Could you change the thread title to "Bought a clocked car"
Changing the world, one sarcastic comment at a time.
  • It's a 54 plate. I was sold it as having 54000 on the clock though which is my issue and why I'm left feeling ripped off. I have just picked the car up from the mot garage with all repair work completed bar the clutch. The said some joints under the car were welded on when they should have been bolted on and this is also a big no no. I wasn't shown the last 5 mot reports when I purchased the car.

This morning I sent a letter to the garage after looking at the citizens advice websites and have asked for a full refund as the car was not as described when sold. There is a sections on the website to advice on used car sales. I will update with you on any replies I receive from them.

Sorry, we're talking about a 12yr old car?

If so, then the difference in value between a 100k and a 54k car is pretty meaningless. In fact, many would prefer the higher mileage one. 100k over 12yrs is not high mileage.

Frankly, I don't believe the "welded on not bolted on" line - if there isn't some chinese whispers there, then they're almost certainly spinning you a line.

Nobody's asking about whether you were shown the last five MOTs. The current certificate has the mileage AT the last five MOTs printed on it.

Selling a car that has got an odometer discrepancy is not illegal.

    Pretending it hasn't is.

And since the mileage issue is clearly shown on the MOT Cert the trader has not hidden the fact.

Cars have theirs clocks replaced all the time.

I would be very surprised if the trader warranted the mileage of a 12yr old Scenic in writing. Especially since they would have seen the mileage discrepancy themselves, unless they are unbelievably dense.

It would also have flagged up on the VMC check.

    Even that isn't explicitly illegal.

But using that pretence to sell the car for a higher price - that IS fraud.
  • The clock was turned back on two separate occasions both over 5 years ago so wouldn't show up on the mot I was shown when purchasing the car. The website the car was on however did advertise it as low milage 54k.

How would a car with 100k be preferable over one with 54k?

Also if any know knows how to change the post title let me know.

    Thanks.
