    Although it isn't clear within the above pictures, my brake lights are on. Whether or not that aids my case, I don't know.

    I can't see your car in the images. All I can see is a black rectangle.

    Unless there are two images with a time difference there is no proof of stopping. A single image of a vehicle with is brake lights on could just mean that it was slowing down without stopping.

    Good point with regards brake lights.


    Would you advise following the newbie initial letter or would you advise simply stating that I did not stop at any point and perhaps point out that their photograph does not provide any proof of a period of stopping?

    I can see it now. Perhaps it was slow loading for me.

    I would not advise anyone to tell an untruth, just in case it ever got to court.

    You could write back and say they have not provided any proof that you stopped, or as this is the IPC kangaroo court appeals system you could ignore unless you get real court papers.

    My present stance is to ignore anything and everything until receiving court papers, although I am conscious that if it were to get that far then the court would not look favourably on my ignore approach. I may, therefore, write a short and simple letter stating that they have failed to provide any evidence of stopping.

    I've had the same issue with a charge issued at the start of the month, I started a thread because I didn't find this one initially when searching. I responded and received a stock letter rejecting the appeal and now I'm not sure what to do. Literally same place as you and brake lights visibly on in the photo.

    Just had a read of your thread. There must be hundreds of people who have recently been put into the same situation.


    At present, I plan to write a short letter back explaining that the evidence that they have supplied (photograph with brake lights on and no period of time) is not evidence of the vehicle being parked, in fact, the fact that the brake lights are on would suggest that the vehicle is not parked.


    I also plan to state that I make no admissions to the identity of the driver at the time of the stated offence and that I withhold my right to make additional submissions should the need arise.


    From then on I will not respond to any correspondence aside from official court documents.

    Yeah, I suspect they've made a pretty penny off this one with such a good location. So infuriating that they can do this.

    Sounds like a good plan, not sure how I'm going to proceed yet; I'll wait too see if I get any more responses from members.
