Our will states if we die together as a family, then last chance dog rescue gets the lot.

If one of us outlive the other, no new partner can inherit our house, it all goes to our kids.

It sounds as though you have a more serious problem on your hands than who-gets-what-percentage.

The key term you need to look up is Commorientes.

With intestate a 28day survivor clause is the default for spouse/civil partners.

The rules are different for IHT and joint property so it can get complicated.

Ye Gods. Making a Will can be stressful enough without having to wonder if a relative will leave your life support switched on just long enough to get their percentage. Disaster clause indeed!

If you would live a quiet life, agree with Herself, and make another Will next week.

Does she realise if she dies, then your son, then you - your brother gets the lot?

Probably not but then neither did I

Think we have reached a solution though.
