I vacated my old flat 4 months back and my deposit is not returned. I signed License To Occupy and the deposit was not protected. I need to know the correct legal action to start against my landlord to recover my security deposit. I am confused between small claim, Part 7 claim and Part 8 claim. Which one is applicable for my case. I am interested to recover my security deposit alone instead of challenging that there was Assured Shorthold Tenancy against the License to Occupy which I signed (though I am aware AST is correct and License to Occupy was just a sham). I am interested to recover my security deposit alone quickly. Please advise what is the correct legal procedure.
