  • Just wanted to post a update on my situation.A few weeks ago I received a letter from Barclays,confirming that they were looking into my PPI complaint etc.There is a paragraph which states " If our client is subject to a DRO,any refund they may be entitled to,may affect the eligability of the order.We will advise the DRO office of any refund that may be due.Please contact the DRO office to discuss this matter further."
    I didn't contact the DRO office,as I have been discharged from my DRO for almost 3 years and thought I would just wait to see what happens.
    Today I have received a cheque (£2087) for mis-sold PPI .....fantastic! BUT...is this mine,or should I expect to be hearing from the DRO office?Fingers crossed!!

    I certainly wouldn't spend any of this money before contacting the DRO office. There is no time limit on them reclaiming this money from you and they've been known to take their own sweet time to do so.

    I doubt you want a bill from them long after you've spent the money. The Bank have already warned you that they will be informing the DRO office of your windfall..

    The money is yours. The DRO Unit do not 'bill people'

    There is a theoretical possibility that a DRO could be revoked retrospectively but this has not happened in the cases I am aware of.

    You do not need to contact the DRO Unit - they are aware of the reclaim.

    Is there anyway to confirm a bit more for the sake of the OP's nerves alone? I would hate to be in the position of wondering about my DRO years later, I know fat belly said it's not happened in his experience but being a pesemist I would worry. Would a call to the DRO unit clear things up or likely prompt an interest?

    Thank you all for your comments......you are so right alltaken,worrying over my DRO more than 3 years after dischage has shaken me up somewhat!I really don't know what to do next.

    Perhaps call and ask, they're human - they would tell you the outcome. If the money is going to cause an issue could it be sacrificed? I'm sure it wouldn't be a full out revocation of the DRO years down the line, sense would say it's something that could not have been reasonably expected at the time and offset against your debts, making you solvent and able to pay instead. I would call them for peace of mind. Perhaps a stance that the insolvency service had as much obligation to investigate PPI you had 3 years ago when you gained a DRO is reasonable? Surely if any doubt surrounding PPI was held a DRO should have been cancelled when discovered in 12 months, not a fair proposition years later.

    They have no such obligation. However, if the DRO office had asked that a PPI complaint be made at the time then there would then be no doubt at all over who should get the redress.

    Again this is all the inevitable consequence of making the post DRO PPI complaint (which the OP instigated without any prompt from the Insolvency service).

    By rights? I'm bankrupt and aware that PPI is not mine, does that mean Somebody in a DRO should have the PPI treated in the same way? I think that's for the insolvency service to decide, they decided apparently that it will not, bankruptcy will not be annulled by sudden funds like PPI, a DRO would be, I think that's the crux of the difference.

    I mentioned earlier that any PPI is something an intermediary or even the IS should have looked at, assessed, and made a decision on the DRO at time of application - by allowing the DRO and it completing I would imagine that the PPI is irrelevant to the IS and would have no bearing. That certainty is likely increased 3 years later, at month 13 of a DRO being granted I imagine it's likely a far greater issue.

    (Unexpected PPI in the sense that it was not expected during or after completing the DRO)

    Give them a call OP, explain you didn't know or reasonably expect any PPI, emphasis on the 3 years later, your intermediary did not expect any PPI at the time of the DRO either etc etc.

    My partner has a DRO at present and received an unexpected bonus last week, 5 months into the DRO. The trigger limit for revocation was not triggered and the gentleman at the DRO unit was very nice and said don't worry, no interest to them and because she had informed them the very next day it was in her favour. So informing them quickly may also show a willingness to be transparent, supporting your view that it was unexpected.

    It is. I never said otherwise. The fact remains that the different types of insolvency are treated differently with regards to PPI complaints, in one the former creditors always get the money and in others it's far less clear cut.

    I agree with this course of action. Though I don't think the OP need to make any excuses, just seek clarification that no further action will be taken for his own peace of mind.

    Thank you so much alltaken.I was out when the cheque arrived and the DRO unit would have been closed by the time I got home.I am going to phone them first thing on Monday,I am taking the attitude that the money isn't mine and just holding on to the cheque!In preparation for disappointment I guess.
