Dro & ppi

Advice needed please....I was granted a DRO in September 2012 & discharged September 2013.A debt that I had with Barclays bank was included in the DRO but is still showing as defaulted each month on my credit file.I have recently been contacted by Barclays,who have told me that they will be sending me a form to fill out in respect to claiming PPI refunds on 3 loans that I had with them.I'm uncertain as to whether I am entitled to put in a claim for PPI refund,due to the fact that a debt I had with them was included in my DRO?....the debt was not connected to the loans I had with them....These loans were paid in full & date back to over 8 years ago.

    You can complain about PPI, but be aware that you are unlikely to receive anything personally. The Bank are entitled to offset any redress awarded against any monies written off as part of your DRO.
  • Many thanks for your response....I would never of considered putting in a complaint concerning PPI,to a bank that I was in debt to & had included in my DRO.It was the fact that they had contacted me that made me raise the question on here.My debt with them was £741.00,which following a marriage breakdown I was unable settle.The bad old days....but things are looking so much better now :)

    Still nothing to stop you complaining about PPI, regardless of your indebtedness. Some would do it just for the satisfaction of having a mis-sale confirmed.


    The Bank automatically write to any and all customers with PPI.

    There are two schools of thought about post-DRO ppi reclaims.

    I have helped a client to do this successfully, argued that there was no debt to offset against and the client received the cash.

    Debt Camel takes a more cautious view

  • Thanks for your response to my enquiry fatbelly....Barclays have given me the policy numbers in relation to the loans,they did this over the telephone.I have received the PPI questionnaire this morning, to complete and return to them.
    I would be interested to know just how much I may have been able to claim,had the DRO not happened.Can you advise please.....as I wouldn't want to go ahead with claiming if there was a risk of it causing me problems in respect of the Insolvency Service?

    You don't "claim" a given amount, you make a complaint about the insurance being mis-sold to you. If the Bank find in your favour, you receive a full refund of PPI paid and 8% simple interest.

    As I said earlier, the Bank will likely want to off set any monies written off as part of your DRO.

    It's always possible the Bank may decide to simply pay you the redress.

    It's also possible that your PPI complaint may be rejected completely. It's not somehow "wrong" to have PPI and it'll only be refunded if you can show it was mis-sold to you.

    Do note that the Bank's invitation to complain is just that, it's just to start a time bar clock ticking to prevent any future complaints and they are writing to everyone with PPI insurance.
  • Thanks....I did take on board what you said in response to my initial question & understand completely.You did say that there is nothing to stop me putting in a complaint with Barclays,if only to prove the PPI was mis sold & which I believe to be the case.
    My main concern is, would going ahead with the complaint forms,cause me to get a 'telling off' from the Insolvency Service? Or am I entitled to put in a complaint,whatever the outcome?

    If you are concerned, contact the Insolvency Service prior to making your complaint.
  • Barclays, in my experience, do not offset against the debt at all for any claims. I stand to be corrected if anyone else has had a different experience, but I haven't seen them do it.

    I agree with Fatbelly, this debt is dead and you can have a crack at recovering the money. Whilst I understand where Debt Camel is coming from, in this instance there is no intention to defraud a creditor, or hide anything, which I have seen some unscrupulous types attempt to do. In that instance, the DRO Unit would be very interested, but in this case I feel you have little to fear, and potentially an awful lot to gain.
