Hi guys, hope you can help as can't find anything on web the same as my situation. Basically, in August 2015 I parked on a large empty car park of a closed 99p store whilst I went in wetherspoons (I have done this for years, didnt notice that in the last 6 months the car park had become privately owned and new signs had been put up). I came out a few hours later, to find my car (along with at least 5 others) had the dreaded parking charge notices stuck on windscreen. I appealed as instructed, saying that the signs had been put up recently so I didn't notice, that it was dark and the signs are small and unlit and that I had caused no disruption or loss of earnings for the company by parking on the empty car park of a closed store - but received no acknowledgement or response from the company Euro Parking Services. Due to them not being bothered to even reply I just ignored it and hoped for the best, I then received a Notice to Keeper which I also ignored. Heard nothing for a few months, then a few days ago I received a letter from Gladstones threatening court action and saying I needed to pay £150, I have written to them briefly saying that the information isnt very specific, it doesn't even give a location, just the name of the store and that I appealed in the correct fashion and received no reply. However, I think I have basically confirmed to them that I was the driver and I am now worried about going to court or having to pay for something which I believe is so unreasonable. The amount of cars on the car park that got tickets on the same night suggests that the signage was not clear! Can anyone help?:mad:

just had a quick look , quiet in 2014 and 2015 but 16 cases in 2016 , looks like they may have teamed up with gladstones
Op we need more info about that letter , is it a WILL start court action in "x" days or MAY take court action ? payment to whom?

Search the forum for Gladstones Letter before Claim; lots of response examples are already here on other threads. even though you have replied briefly there is nothing to stop you sending something stronger now to follow it. You should dispute the charge and not leave the ball in their court of they reply - reply again!
Get some photos in the dark of the signs if you can - soon, in case court papers follow - and whilst there, ask the Wetherspoons Manager whether they cancel PCNs for genuine customers and if he/she cannot, who to complain to who can cancel it. Be assertive but polite.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Wow, thanks for the speedy replies! I'm away at the moment and don't have the letters to hand, only details from emails. I know I got the charge on August 13th 2015, I then appealed as instructed on the 14th stating signs weren't lit etc etc to which I received no reply. I think I got the NTK in October, I replied saying I had appealed and had no reply to this to which they said a reply was sent on the 17th August (3 days after I appealed) However, I had no such response in my e-mail, I had got the company in my trusted senders anyway but checked my junk mail in case and had nothing! Have kept all emails in case it does go to court! I see from your post pappa that they were in trouble but the case against them was dropped 9th April as far as I can see? The letter basically says that if I don't pay or provide a satisfactory response then they are instructed to start proceedings against me. Not sure if it is important or not but the store in question was a 99p store but the letter doesn't say which one, just says 99p store so surely I could pull them up for failure to provide information in some way? In response to coupon mad: I have looked at other examples before posting, can't find any the same though, mine actually says in the box at the top to make a payment call Gladstones (as opposed to Debt Recovery). Also, there is no way I can get photos now as the store has been taken over by another company which doesn't have restrictions in place! Also, from the links provided by pappa I can see that the company has it's Annual Returns Overdue?0

And it is headed up Letter of Claim? Then look for responses here or on pepipoo specifically to LBCs.

Okay it is headed as a letter before claim? I will look at some of those type letters then! And what is the difference between payment to gladstones and payment to EPS then pappa? Also what do you reckon of the trouble that the company is in? I had a look through the companies house and found the director of EPS was manager of a company that dissolved before he started EPS which is now also in trouble?? What do I need to do if Gladstones is acting as Debt Recovery rather than solicitor?0

You need to only read threads about how to reply to an LBC from Gladstones. Easily found with the search words suggested.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

if it does kick off and there is a time gap , check companies house to see if they have gone bust
they are 2 mths late with there records , that's £375in fines , another mth and it goes upto £750

so what do I do if treating it as a letter before action? I have emailed Gladstones on Wednesday night and had no reply as of yet (Friday morning). Cannot be bothered either writing or phoning.0
