    I'd go round this neighbours with all that evidence. If they are cooperative then leave it there but if they prove to be the opposite make sure you send a formal letter giving them 28 days to return the fence to it's original position before you take legal action.



    Does it make a difference how long it's been up for?

    Is it all the way down a long garden, or is it literally just the section next to your garage? If its next to the garage I would leave it but if it's a lot of land I'd take it more seriously. It seems odd that there was not half a flower bed taken out, for example. How did the 10" get used?

    What evidence?

    OP hasn't said they have any yet, except a Google Map. They may well assemble some more, but it's early days.

    The tenants might be willing to put their names to an affadavit, but there again, they might not.

    I bet its so they used less fence panels, ie the side of the garage is now the boundary. Cheeky monkeys, I wouldn't be happy. And as someone said it will now look as if garage is encroaching on their land.
    Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.

    Not true ..assuming the encroached land is registered land,
    after 10 years’ adverse possession, the squatter will be entitled to apply to be registered as proprietor in place of the registered proprietor of the land. (Schedule 6, Land Registration Act 2002).

    You have every right to ask them to remove it, speak with the neighbours and ask them that it has to be removed. I'd be tempted to mention that the council could get involved if they don't, just to speed up the process!
