PCN confusion

I have read the stickies on the forum but have to admit to being utterly confused as to what I should do next.

I received a PCN on 11/4 from an IPC accredited operator for being Parked within a restricted area. I was parked off road outside my hotel in Slough.

I appealed, before I visited this site, and committed the error of identifying myself as the driver. I appealed on the basis that the signage was lost within a cluster of 10 For Sale/To Let signs and was in a poorly lit area. The sign is also placed at approx 8ft above ground level. The photographic evidence they provide shows the lack of visibility.

The appeal was rejected because it was parked outside of a designated parking area and that by parking in this manner i agreed to pay the stated charge - £100.

I have read on the forum that it's not worth pursuing through the IAS, although I have two weeks left to appeal. Keen for advice as to what should I do next? Pay up, complain back to the Company or ignore the barrage of debt recovery letters?

My experience, you can always find a fault with the issued notice. Are you saying the signage is irrelevant because you wasn't parked in the designated parking area? what was the PCN issued for, what was the offence?

Complain to the hotel management. If you can get a pic of the entrance taken in the same poorly lit conditions and showing all the clutter that distracted you, then show/send that to the hotel manager and demand they get this cancelled or you will tell everyone you know and lots that you don't know about this scam.
Leave poor feedback on trapadvisor, tw@tter, and fakebook as well as local press

I would suggest ignoring anything you get now unless they are real court papers.

I have no idea why you would consider paying a parking scumpany.

    Which PPC?

Google their name plus 'BMPA zendesk' to find a summary of whether they sue people.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks everyone for taking the time to reply.

ralph-y can you explain what you mean by: do not ignore real letter before claim letters !

The Company is Parking Control Management and I'll have a go at Googling as you suggest Couponmad.

There were no designated parking bays where I parked - just undeveloped land, not even a pavement.

I have complained to the hotel but received no response - I will up the outrage on social media as you suggest.

What is the offence on the PCN?
    What did the sign display?
Is it private or public ?
    Are there clear boundaries/markings
Have you rec the Notice to Owner?
(There will be an option to take the matter to an adjudicator if the issuing authority declines your appeal at this stage)
What stage is the PCN at?
Were you allowed to park there and if so did you need a parking voucher from the hotel to do so?
Please supply as much info as possible. Thanks

Appeal to the IAS if you have that option and turn up in person (if its still allowed). You only need to show them that you where entitled to park there as it was your hotel.
    You have nothing to lose.

the way this works is ....

the nice chaps who have sent you the invoice belong to a trade body the IPC

any member of the IPC will always 99.9% of the time refuse the appeal.....

you then get lots and lots of debtcrawler letters .........

    which you ignore .......

however there is a small chance that the PPC may try court ...

the dentcrawlwer can NOT do court ever ever ....

the reason for the IPC template is to discourage the PPC from trying it on .....

    and

start a paper trail to help you should they try further action ....

which would be a 'letter before action' from a court

(not a pretend one from the debtcrawler)

    it sound scary ...

if you follow forum help it should not be ...

    good luck

Ignore posts #7 and #8 ... they seem to be talking about Council tickets and the Traffic Penalty Tribunal (or whatever it is called these days). What you have received is a civil invoice from a private company.

Generally, I disagree. The OP could 'register intent' to appeal, to see a preview of PCM's case evidence, but unless there is something obvious like no signs then just ignore after that. I would say, do not proceed with IAS appeals unless there's something in the 'evidence' (that they have to produce as their case) there for the taking.

Even then the IAS expect the appellant to prove everything beyond a reasonable expectation - yet the bar for the PPC to meet is ankle-height - hence IAS is considered by most here, a kangaroo court.

and turn up in person (if its still allowed). You only need to show them that you where entitled to park there as it was your hotel.

This is wrong advice, this isn't that sort of PCN. There is no issuing authority; it's a bunch of ex-clampers!

Would be OK to talk about 'turning up for adjudication' if it was a Council PCN but the OP has said it's PCM; easy enough to Google and search the forum about them. Already covered in the NEWBIES thread too. IPC firm.
