Ok thanks. I only included the byelaws point as everyone else seems to for this particular car park. Defence submitted just in time.
I think the most important factor in my case is that the terminal for entering car registration details to qualify for the 4 hours free parking is inaccessible at 4:00am due to the main Leisure World complex being shut. Surely this is unfair. I do not believe there is a terminal in the nightclub and wasn't told if there was one in any case. So it was impossible to adhere to the terms and conditions, even if they had been seen, which they hadn't.0 -
So now do the emails if you haven't already, to PE's enforcement team at to the appropriate retailer/cinema Manager to press them to consider cancelling as the driver was a genuine customer.
Sometimes retailers have paid the £60 to squash a claim flat. Some have agreed to meet half the cancellation costs and some are useless but you lose nothing by trying.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Don;t forget as well, it is for PE to prove the land IS relevant land, and prove exactly where the boundary is. The byelaws are sufficiently clear to make the point to the judge that this may not be somewhere PE can enforce, and there are plenty of POPLA decision supporting this.
Even if the landowner is now Rank, that doesn't mean the byelaws have stopped applying to the land.0 -
Ok, to update Parking Eye have sent me a letter asking for £60 without prejudice to settle the claim, rejecting my offer of £20. They were asking for £175 including court costs in the county court letter they sent previously. I'm tempted to accept to put closure on it, but don't know if I would have a chance of winning if I went to court. Any advice? Cheers.0

its your choice, to either make a counter offer , or not , or pay
all depends if you are up for a fight or not, but they may settle for say £40 ? halfway ?

Exactly as predicted then. A lot of people would settle, then up the ante with the complaint to the landowner because then you can show they caused you loss if the Nightclub didn't point out the keypad VRN issue.
If you fight on, it will be a battle and take up lots of hours over the Summer...you will face a solicitor and you are more likely to lose v PE than win (just saying it as I see it and they WILL proceed to court). This £60 offer was what I was hoping to achieve for you, because you should have appealed and complained at the time, this was a mistake:I had previously ignored all correspondence relating to the matter using the outdated assumption that such PCNs were unenforcable.

I went back to the location last week at night to check out the car park for signs, notices, terms & conditions etc and read the info on the ticket machine. All the parking signs are 8 foot high and impossible to read unless you go right up to them. I took some photos of the signs and the car park all prepared to add to my defence and then the £60 offer came through the post the next day.
I was also anxious to check out where the terminal was for inputting car reg details. It is in the Leisure World Complex itself, by the entrance to the cinema. There is no terminal in the nightclub which is joined on to the complex but has its own entrance. So as I thought, it would have been impossible to enter my car reg on the terminal as the complex is shut at 4am yet that is when charging hours resume.
I was only able to gain access as a cleaner had left the complex door unlocked. He showed me where the terminal inside was by the cinema and told me he got a ticket himself when parking there for his job interview! His manager sorted it out for him but he thought it was disgusting when I told him about my ticket for parking there on New Year's Eve.
Anyway I haven't got the time or inclination to fight this further so I have paid the £60 through gritted teeth and have learnt not to ignore these PCNs again. I've had 3 or 4 from private parking companies in the past and the ignore all correspondence tactic had always worked, but now I know different. Thanks all for your help.0
