Parking charge notice recived from parking eye

Hello I'm hoping some one on here can give me some much needed advice.

On the 6/04/2016 my dad parked in car park paid his £1.20 for one hour of parking, He said the machine was odd and only let him put in numbers of his reg, on his car that's only 05. He got his ticket and He then popped to the one shop he needed to go too. It's now the 18th and we have recived a letter from parking eye saying he dident pay parking And needs to pay a £100 parking charge. I have hunted all over the car but we no longer have the ticket to prove we parked & they have a picture of the car entering the carp park at 10:59:54 and leaving the car park at 11:10:36. So the time in the car park was 10mins

I'm hoping some one could give some advice on what to do in regards to appealing and not paying. As we have no proof that we did pay. My dad does usually take a picture of his ticket in the car but that was the thing he had gone to collect from the phone repair shop.

The event is dated as the 6th the date they issued it is the 12th and we have recived the letter on the 18th (today) they have offers a reduced charge of £60 if we pay by the 26th so any quick advice would be greatly appreciated.

    Please read the Sticky thread for NEWBES then appeal using the BPA template in blue. Copy and paste, no editing so the driver's identity is not accidentally given away.

    If/when parking lie reject it you will need to read up on PoPLA and make a second stage appeal. Come back to this thread if you need more help.

    Do not pay, do not ignore, do not reveal who was driving, do not miss the appeal deadline.

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

You see i dont no what to write for the best. do i say honestly that we havent kept the ticket but it was paid using the number 05 as the only info we only had to pop to one shop. or should just add something about a a grace period as we were only in the car park for 10mins.

    1: they say you have not paid , that's because you claim you did not like terms and conditions you left (grace period) the time you entered and left was done by cameras at the entrance , some distance fron the meter.


    2: if they insist you parked , then you will require a full list of cars entered on their computer along with a list of all vehicle recorded by camera , between 10:59:54 and 11:10:36 it will be noted that a vehicle with the reg of 05 tried to purchase a ticket , knowing this was wrong and having no more change they left the site

    You can as long as you say 'we' and not 'I' and put the appeal through in your Dad's name if he's the keeper of the car, the person to whom the PCN was addressed. Don't give away who was driving.

    Also add a line to tell PE that the driver paid £1.20 for one hour of parking and found the machine was odd and only let him put in numbers of the car reg. So, they must check their records and will match his payment to the simple keypad entry '05' shortly after parking.

    Be careful NOT to say 'I', just say 'the driver did this/that'.

    I think they'll cancel.

    I have had a reply stating hat my appeal has been unsuccessful and that I have now reached the end of the internal appeal process. I have now been told if I wish to continue the appeal it would have to be through POPLA. but the letter warns that if unsuccessful I will have to pay the full £100 & not the £60 reduced fee. Can anyone give advice on my next move. £60 is bad enough without trying to find another £40 on top. As I said before we have no ticket proving payment for parking so no evidence ect. Any advice will be greatly appreciated thanks :)

    It all boils down to are you telling the truth or not. You can jump through their hoops and appeal, you will probably win, or, and this is what I would do, challenge them too take you to court.


    If you appear truthful, the judge will find for you, if you are riff raff he/she may not.


    As Inspector Callaghan would say, "do you feel lucky?".
    You never know how far you can go until you go too far.
