Parking Eye - PCN

Good afternoon!

I have been through the newbies section and i think i need to start a new thread!!

I received a PCN on 19th March for £75 where i allegedly parked in my local farmfoods for 1hr and 15 minutes...

I have done some digging and neither myself or my wife were anywhere near the car park on the day. My wife is an Avon sales rep and during the times mentioned she was out delivering, Also on the date in question, Farmfoods was actually closed for a major shop refurbishment (Farmfoods have confirmed this)

I did the PE appeal and i have today received a letter saying that i have been unsuccessful !! I really have no idea what to do next... The POPLA route seems to have set things for appealing and other says it is unlikely to be successful.

Any advice folks?

    but just for starters

    Can you obtain any provable details as to where the resisted keeper / diver / car was at the time in question?

    what did you actually say in the first appeal?

    was the car park closed during the re vamp?

    I basically told them that the supermarket was closed and that we were else where...

    The supermarket was been re done out and the car park was full of porter cabins etcs.. Yes you could probably still park, but we didnt!

    Parking Eye almost always send photos of vehicles entering / leaving a site. Did they not send you photographs and if not, have you asked for them?

    Yes, surely the PCN had photos - is it your car or have they misread the VRN?

    Or could someone else have been driving (family member)? It is not a defence nor a valid appeal just to say you were not the driver, so do you have an inkling who the driver was, if you are satisfied the pics are of your vehicle?

    POPLA can be winnable so do not think it's not worth trying. You do not have to pick out a set reason to appeal that ticks their silly boxes and we ALWAYS submit a full PDF appeal under 'other'. POPLA have no figures at all to base the assertion that 'other' is less successful...that's utter twaddle made up by new POPLA before they even started, because they wanted to corral every appeal into a nice easy box like 'I didn't see the signs'. So ignore all the rubbish the POPLA website tells you and listen to us instead!

    Just don't base your draft on any POPLA examples from 2015. Look at current ones shown in threads on the first 20 pages or so of this forum, from this month/last month.

  • Hi! Thanks everyone

    PE have indeed sent pictures and it is my number and the same model of my car. But we are one million percent that we weren't there at that time. My wife is an Avon lady and was out delivering at the time to which her customers can confirm.

    She did go in on the 15th March when the store had re-opened and we have the receipt and it is time stamped 16:37. The incident was supposed to have happened on the 3rd March when the shop was closed!

    Any advice on what to do next would be amazing

  • Hi, I got two parking tickets at ASDA off smart parking, I ignored due to what I read online, they have both now been passed onto a debt collection agency. Im here now because Im now reading that the law has changed and I will get took to court and forced to pay the whole sum. Im 18, get £30 a week in total, £10 off mum, £20 college bursary. Just wondering if I really have to pay it, or should I just keep ignoring until they let up. Thanks for reading

    please remember that this forum is run by volunteers ..... most of which work ......

    have you read the newbies thread ?

    have you been back to homebase to complain ?

    have you got any provable evidence to back up your claim ?

    statements ... receipts ...gps logs ....

    may be contact the police to ask about reg plate cloning ( they would need to see pictures and information as above ......

    but they may well not be interested...

    forum backed appeals have a very , very high success rate ........ that is until the new POPLA took over ...... they have had some training issues ....

    have you started looking at POPLA appeals that you might use/ crib for your case ?
