  • Hi just got home from work and he is parked at the front of the drive, so I am parked across the dropped curb. I'm currently waiting for my land registry activation email so I can buy and download the deed copy as I have not seen it yet. Will update once purchased.

    2 (02.11.1992) The parts of the passageway at the side included in the title are subject to rights of way.
    3 (23.03.2016) REGISTERED CHARGE dated 18 March 2016.

    Okay it says this about the side, so I presume it means it must be clear, and his will say the same also. Also the 18/03/16 is when I moved, not sure if this has anything to do with it, just below it.

    Edit:

    (02.11.1992) The land has the benefit of a right of way over the part of the passageway at the side not included in the title.

    I wouldnt go for solicitors yet, thats a route towards dispute and LOTS of expense !

    Approach him again, point out its a drive for access which he is blocking, flip it to him -"how are we going to resolve this so I'm not blocked from accessing my property?"

    Be firm but super calm, you are not asking for him to allow you to do anything with what you have paid for - be clear on that - he needs to stop preventing you. I think the mindset that you approach this with right now is vital, you dont need to apologise or feel you are being awkward. He has got used to living next door to an empty property and now he needs to get used to you being there. Good luck !

    I will have a think tomorrow at work how to try and not sound to hostile and will go round and have a word tomorrow after work. Thanks for all your support and advice.

    His van is probably full of tools which he doesn't want to be stolen. This doesn't excuse his actions but will give you a better understanding of why he is doing it.

    Personally I would be up very early and/or very late in during your 5 days off and ask him to move it everytime, even if that was 20 minutes apart (get up at 4, go for some milk, then come back and disturb him again). I would invite friends round with boxes full of things that need to be taken up the shared access and others that need to collect stuff (friends in the pub/club/restaurant trade would be great for some unsociably timed visits!). It shouldn't take long for him to figure out what needs doing!

    Is his garage big enough for his van if it did not contain a load of ****? You say his mother is in care? Why not get him to put the contents of the garage into store, so he can use it.
  • His garage is too small height and probably also length ways. He's not in today so I'm parked round the back. If he comes back tonight I will go round and ask him to move and also mention it. If he doesn't come back tonight just going to leave a note because I'm on night shift tomorrow and parking is at its worse at 6am.

    So there are general entries (no details) re a right of way over the passageway at the side - I assume the shared passageway is in essence the drive here

    The registered charge relates to your mortgage so won't relate to any rights etc
