    Perhaps they just want to ensure that your daughter doesn't start a claim against them afterwards.


    Obviously we are not agreeing to anything but how should she handle this if they call again...TIA
    Just thank them for their offer but you are looking forward to seeing them in court.

    All paperwork has been submitted to court and unless the court notify us that CEL have discontinued then we will be attending. Thanks for your help.

    Hearing took place this morning...we won...claim dismissed and costs awarded ...feels good!

    mmmmmmmm , cant believe this saga has been ongoing for almost 3 years, but congratulations on the win and common sense prevailing , its great news

    deffo interested in a court report and what the judge said etc

    Just goes to show that people do NOT need to panic when a POPLA appeal is lost.

    Please can you give us a full 'court report' about how the day went, what the rep for CEL tried to say and how the Judge shot them down and found in your favour, on what basis?

    And as well as your report of the experience, which court and which Judge?

    Bet CEL thought because POPLA rejected you, it would be plain sailing in court .......

    I assume CEL are not up to speed about POPLA ....:rotfl:

    Perhaps you should write to John Gallagher (Lead Assessor) and ask that he reviews this POPLA decision that has been turned on its head by a Judge, and ask for his views on POPLA’s errors and whether he feels there is some need for urgent retraining of his staff?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
