Popla appeal unsuccessful...Civil Enforcement

My daughter received a pcn from Civil Enforcement Ltd after parking in Market Street, Cleethorpes...it stated for parking "not in accordance with the signage". She still had the 2hr ticket which she had displayed and not exceeded and so challenged the pcn...it was rejected and she appealed to popla although at this stage she still did not know why the PCN had been issued. Popla advised it was because she did not enter her full Reg number but just the figures (which was a genuine mistake) and she has now been informed that her appeal has been unsuccessful and been given 28 days to pay £100!!! Any advice please?

    when (and if) this mob take you to the county court , you will ask for a full printout of vehicles entering and leaving the site , along with a printout of all vehicles that have registered on there system , this will clearly show the full reg being shown by ANPR cameras and the reg number on their system of a vehicle that was not on the site

    This was a chance missed; in fact CEL are dead easy to beat at POPLA. But not on the basis you described.

    DO NOT PAY £100. No-one is going to send the boys round but more letters and demands will arrive.

    Ignore them unless they try a small claim, which is defendable. They do try a few and we assist people with those defences too and no effect is had on credit rating, nor do bailiffs come knocking, nothing. Just don't ignore a Letter before Claim or actual Court papers, and keep all the paperwork, Notice to keeper and the proof of paying the ticket, in case it is needed later for a small claims defence.

    Missing out some digits from a VRN on the machine keypad is not a heinous crime and CEL are trying it on, as this industry always does.

    To get it cancelled now (I would) complain to the landowner and/or retailer Head Offices. That's what the 'NEWBIES PLEASE READ THESE FAQS FIRST' thread says, near the top of this forum. Loads of successes shown on a linked thread all about complaining.

  • I would defend this solely on the premise that you are being penalised for a minor mistake when you otherwise used the car park as intended . Forget any other legal arguments or template defences you may come across. They won't take this to a hearing IMO but you may get an LBA and a court claim to coerce you into parting with your dosh .

    On site retailers/occupiers
    Google
    Local Authority planning Department
    Local Valuation Office
    Local Press (may have covered the opening of the site?)

    None of these guaranteed, but a place to start 'for free'.

    If you want to pay (around £3 or so) contact the Land Registry who will certainly provide you the details.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Have a look on your 2 hour ticket; there should be a VAT number which will tell you who you actually have a contract with.

    My daughter has received a 14 day letter today in respect of this matter together with particulars of claim...the debt now stands at £140.00. Any advice greatly appreciated...thanks
