barclaycard and credit file

Hello, my husbands credit file details his barclaycard with a start date of 2008 and an end date of 25/10/2011. However, Barclaycard have continued to report it as an inactive account for half of 2012 and whole of 2013, they have then added sustained arrears markers for feb,march,aril 2014 and finally may 2014 marked it as partial settlement.

At the time, approximately 2011, they agreed to write off the balance due to medical grounds and my husband not working. I have paperwork to this affect in my loft.

My question is, despite them agreeing to write off the money owed, are they allowed to mark his credit report as above? Im confused, because it says account end date 2011, yet they continued to mark his credit report until 2014?

any help appreciated, we are trying to repair our credit reports for a mortgage, so seeing this has put a hole in our plans :(

    They can mark the file as Partially Settled and update the balance to 0 possibly as you did not pay the full amount to them they wrote it off. You should call them and see if they will update it to settled, You should raise the issue of reporting arrears till 2014 as it effectively closed in 2011 if this is wen they agreed to write off the balance. this would then drop off your credit file in 2017 anyway. What date does it report the account as closed on th credit files.

    Thanks, the file is marked as partially settled. I called them earlier, they said that they agreed to write off the balance in june 2012, I explained to them that it showed the balance as zero from that time until feb,march,apr 2014 when the balance reappears. May 2014 states 'partially settled'.

    He says they received medical evidence from us in jan 2012, and that what they record on credit file has to be a true reflection of the facts.....but the credit file states the account ended in 2011?!!!

    I have put a dispute in with noddle, should I put my concerns in writing to barclaycard?
    I said to him numerous times that I didnt get how it was written off in 2012, to then reappear for three months in 2014 to then disappear again. he just said they need to report the truth and they did not add a default to it...

    the account end date is 25/10/2011
  • Hi, an account can only stay on your credit file for 6 years after the account closes or 6 years after the default date if it states closed 25/10/2011 then it should drop of your credit file in October 2017.

    However if balance has been agreed to written off it should state balance zero. They can probably say it was fair to update the record as partially settled, as they did not receive payment in full to close the account.

    You should make complaints to Barclays, Is there any other negative data on your file or is this the only account.

    I disputed the history with noddle, they have replied stating that Barclaycard have said there is nothing they can do as they 'have to reflect the facts'. But surely, the facts are, it was 'charged off' (whatever that means) in 2012, so why would the balance be revived two years after that before it stating 'partially settled'.

    There are a couple of missed payments for very....but these are only from forgetting to pay the postage when t was due, because everything else was buy now pay later. Think I will write to barclays, they were not very helpful on the phone!!!

    if the account was settled the in 2012 the entries should stop there.

    I've had some success via this method santander in particular

    state this is against the regulations on credit reporting. if the marker says it's settle or partially settled then they can't report any other information on your account from that point forward unless you've made payment plans with them to repay in 2014.

    This is what it states:

    23/06/2008
    Account end date
    25/10/2011

    Payment start date
    23/06/2008

    Repayment frequency
    Monthly

    It says 'sustained arrears' in may 2012, with the balance being £1861. However, from June 2012 is states 'dormant/inactive account' with the balance as zero.

    Then feb 2014 it states 'payment was six months late, sustained arrears' with a balance as £1886 until may 2014 when it states 'partially settled'. But if they 'charged off' the balance in 2012, shouldnt it state partially settled from then? and shouldnt the account end date be that date too instead of 2011?

    Hi Kezzygirl, I'd challenge this with the credit reference agencies as the information is incorrect and not a true reflection.

    explain to them that the information is incorrect and you'd like them to challenge barclays information state if it is incorrect then experian need to have them remove it.

    if they refuse, complain to the financial Ombudsman and the ICO

    Noddle have already replied saying that they have been in touch with barclays and they ar enot willing to amend the entry, stating if i have any further queris to speak to barclays directly. should I just go straight to ICE/FOS or give barclays one more phone call?

    to be fair you wont get far with Barclays now.

    most companies when challenged by the credit reporters just say everything is correct.

    raise your complaint with the fos.

    you could always raise a complaint in the barclays online system but that takes 8 weeks to run through. usally after that 8 weeks you go to the FOS.

    in my experience the power of a written complaint compared to a phone call always seems to produce a better result. it gives alot of weight and evidence which you can call upon if they are not acting reasonably.

    I used the resolver.co.uk website here and made a complaint against a number of companies most reply within a week or so.

    UPDATE!!!!!!

    Thank-you for your comments, especially the comment re.using resolver. I have had a response from barclaycard today, they have found in our favour. He said that the credit file should not have been reported on from the 'charge off' date onwards and will amend it within 24hrs to reflect the date the account ending at Jun 2012.

    He siad that he was listening to the phone call I originally made, and throughout was thinking that the customer assistant was not actually listening to what I was saying, and did not address what I called for. He said they were sending me a letter this afternoon outlining their actions for my reference, and including a cheque for £200 as a gesture of goodwill! All in all, great result. Thanks for all of your advice!!
