Sick leave, employee rights

Unfortunately, the law is the law. I appreciate it can hit small companies hard as can things like sickness/maternity leave. Key worker decides to take max time off to have a baby. Surely you're not suggesting we go back to allowing employers to say sorry you're out of here we'll get someone else in?
Also, a company car can be part of a salary package, i.e. £30K plus car, so, yes I agree to a certain extent, you can't just decide to remove part of the package. I've had jobs like that where the car was a significant part of the deal - otherwise it wouldnt add up. Its like saying, sorry you're on maternity we're going to cut your pay in half.[/QUOTE]
a lot of companies don't pay maternity over SMP so its woul dbe more than halved in most cases0 -

Of course, it all depends on your contract of employment.
Point being, companies can't do what they like just because they don't like the idea. Pretty sure if you've got a company car they can't take it off you if its part of your contractual package....0 -

I would expect they can, for any period you aren't working, I would be surprised if its not in the contract terms that they care isn't available for just personal use if you aren't working for a year0 -

I've worked in a few places and had company cars and never seen this happen.
Of course, depends whether its a true company car (i.e. yours to use for business and personal use and you pay the BIK accordingly) or just one that you use for business - like a pool car.
Whenever I've had a car its always been on a lease anyway, so the company has to keep it regardless. I remember they had enough spare cars to use as pool cars because people left the company without having to take ones off people who were on maternity.
I must admit I would wonder if its even legal to have such a clause in your contract though. i.e. You will get paid £30K per year and have a company car but you've got to give it back if you're pregnant.
I've been made redundant in the past, had three months gardening leave. Apart from having to pay me for this time, my employer could not absolutely take the car away from me until employment officially ended and not a day earlier. So for those three months I did zero business miles but still had it for personal use.0
