of both parties. Changes may be agreed on an individual basis or through a
collective agreement (ie: agreement between employer and employee or
their representatives (trade unions or workforce representatives)). "
Doesn't matter if i'm going back for a week or a month, i'm still under same obligations to do my job and for employer to give me back my job.
Yes, i know they weren't happy i end up on sick leave just before my maternity, but i couldn't help as its was emergency surgery, i don't expect my employer to feel sorry for me.
Only thing what i would like it to find my rights as employee. And there is so much info on internet.
Im not trying to be arrogant, just being pregnant and when someone is possible trying to sack you, its just not right.
I got only welcoming letter, and there is nothing about company benefits, i been asking for contract or terms and conditions regarding company car, but haven't got anywhere.
There is more issues with my wages, but thats another story.
Employer will come to my house tomorrow to collect the car, but they don't want to answer any of my messages or give me any paper work.
How long have you worked there?
The ACAS website is not fully correct. Of course the employer can alter a contract, just needs to give sufficient notice.0 -

But as your role requires you to drive and you have stated that you cannot drive, what are they to do?0 -

I will be able to drive when I return in 1,5 weeks time.

Ah, I'm an idiot. I usually ask, but for some reason I didn't. As you have been told less than two years means you have few rights at all. The pregnancy gets you some protection as does maternity, but not nearly as much as you'd think. Especially since it seems that you won't clock up the two years until after your maternity leave ends. And that means that redundancy could be on the cards just about the time you come back - in fact the minute you set foot through the door and have no protection at all. This would therefore be a good time to not annoy your employer. And as for not being able to change your contact, right now they can do pretty much any change they like and there would be little that your could do about it. And to be objective, if they have never given you any paperwork about the terms of the car, you can't really claim it is yours to use when and as you please.- You have never known what the terms were so you are assuming you could could keep it.0 -
just spoke with acas. even i haven't been employee for 2 year its still go down to discrimination, because im pregnant. as they cant change t&c as they wish. i don't really care about redundancy after my maternity leave as long as i will receive full smp.0

If its such a small company then they will probably not be able to afford to be without a company car throughout your maternity leave.
Look at it from their point of view, you have been there less than a year, are off sick, now going on maternity and you expect them to provide you with a car as well. I would say your days are numbered.0 -
They been a pain in back site for long time, but i stick with them because otherwise i would loose on my maternity pay, yes, its would be more easily to take that week off, but i don't want to, why should i loose out, when i would be capable to do my duties.
They haven't completed risk assessment, but they know since Jan that im expecting a baby. As per acas and other advice its would be discrimination towards pregnant women to change my work duties to lower level and remove car as im due to return to work.
They don't have grounds to dismiss me.0 -

What else has happened between you and your employer prior to this - there seem to be some very entrenched positions which make me wonder what has happened between you prior to this saga?All shall be well, and all shall be well, and all manner of things shall be well.

And then they wonder why in my line of work females are hardly ever employed.
I know you're not supposed to say that, but it strange how its always the male candidates are always most suited to the job.0
