im employed as area manager, not as admin staff.
I know that im only returning for one week only, but still change of terms and conditions have to be agreed by both parts.
And due to this changes they want to remove car, im paying tax on it already, and have since day one of employment. They do know that i dont have personal car or any other way to get there, no buss service etc.
Probably they just want my resignation, as i dont want to agree on this changes and i wont be able to make to work place for this one week.

But being a good manager is about 70% admin? If you're only returning for 1 week I imagine that week will consist of mostly a handover?

Presumebly you wont be paying tax on it once the car goes to another employee.

Have they said they wont give you a car once you finish maternity?
  • If you are paying tax on the car then it isn't a pool car, its a benefit that you are entitled to keep during Maternity Leave. I would contact a good Employment Advice Solicitor or at least give ACAS a ring.

Sounds like you are laying it on a bit thick!

I get myself to work...my employer doesn't need to know how.

As you are only returning for a measly week prior to your maternity leave, they have most likely employed somebody else to take on your role, do you expect them not to get cover for your sick/maternity leave?

Its a bit unfair for you to expect them to bow down to you when you've been off sick, only returning for a week before leaving again! They've made a decision based on these facts.

Since when? No they don't. Your only entitlement is what is written in the law that protects you. Everything else is for the employers to do as they wish.

Not forcibly, again, it depends on how it is worded on the policy. It might say that the user is entitled to use the car for personal use, but that might be attached with specific conditions in regards to work/duties.

A friend of mine got de-promoted. The type of car they get is depending on their grades, so he had to return the car and get the not so flashy one, and another colleague took a 3 months unpaid leave, approved, but had to return the car as it was clearly stated in the policy that the car could only be used for personal business if also used for commercial benefit to the company.

    Gosh, how arrogant you sound.

Perhaps if you'd paid more attention to the 'admin' you wouldn't be in this position now.

I'd have expected much more proactivity from a management grade. Surely you've been making handover preparations etc? If not, you've not really performed to the requirements of a management grade.

    Poor performance.

Perhaps I'm missing something obvious but... can't you just get a car? Or a motorbike? Or a scooter? Or a hire car for the week? Or taxis? Or a lift? Or local accommodation, if you were really desperate? Would you really rather lose your job than sort out your own transport to work for one week?

You're probably right. I would, in their position.

Murzite are these changes relating only to the week that you are back at work prior to maternity leave or are you saying that the changes are to extend to after your maternity leave?

If it's just about the one week then you will just have to suck it up and find a way to get into work. Your partner may well be insured to drive your company car, partners of company car drivers certainly are in my place of work. Do check that as he can get the vehicle back to them for you. You are entitled to all your contractual terms whilst you are on maternity leave, this includes your car.

Can you clarify exactly what they've said to you?

    From ACAS website:
"An existing contract of employment can be varied only with the agreement
of both parties. Changes may be agreed on an individual basis or through a
collective agreement (ie: agreement between employer and employee or
their representatives (trade unions or workforce representatives)). "

Doesn't matter if i'm going back for a week or a month, i'm still under same obligations to do my job and for employer to give me back my job.
Yes, i know they weren't happy i end up on sick leave just before my maternity, but i couldn't help as its was emergency surgery, i don't expect my employer to feel sorry for me.
Only thing what i would like it to find my rights as employee. And there is so much info on internet.
Im not trying to be arrogant, just being pregnant and when someone is possible trying to sack you, its just not right.

I got only welcoming letter, and there is nothing about company benefits, i been asking for contract or terms and conditions regarding company car, but haven't got anywhere.
There is more issues with my wages, but thats another story.

Employer will come to my house tomorrow to collect the car, but they don't want to answer any of my messages or give me any paper work.
