Advice needed with UKCPS

Hello

Just to confirm, I have read the threads and stickies but I'm still a bit unclear as to whether to ignore this or not

Basically my son parked on what he thought was waste land one evening back in February. He didn't see any signs but it was dark. When he got back to his car, he had a ticket on the windscreen which he has ignored. He has now just received a NTK from UKCPS asking for £100. I have checked and indeed the sign is impossible to see in the dark. Do I appeal this to IAS (what I have read on here suggests not, I think) or do I just ignore everything until a court summons arrives? Is there a way to make it go away before it gets to that stage?

I'm not a legal person, I just want to help my son

    Who is the registered keeper of the vehicle? Whoever it is should send an initial appeal to the PPC. The appeal template is in the newbies sticky, post #1 and it is the IPC version that should be used in the timescale outlined in the sticky.

    When the rejection letter is received, come back for further advice as there is a new, emerging strategy for approaching any subsequent IAS appeal.

    Hi - my son (the registered keeper) received the rejection letter (a month ago, he only just gave me it)

    You've wasted more than a month from your last post. Any appeal opportunity is probably long gone (not that an appeal to UKCPS/IPC/IAS was likely to be successful).

    Your son - who needs to be dealing with this now, not you - will shortly be receiving (powerless/toothless) debt collector letters. Check with him if he's received any of these yet?

    UKCPS are litigious, so he (not you) needs to deal immediately with any court papers (or Letters Before Action) sent by UKCPS or their solicitors BW Legal, or Miah, or Gladstones usually.

    Come back and let us know where he is. Then we'll give him advice on how to handle this. If it comes to court - you won't be able to take everything on board for him; he will have to step up to the plate, so the earlier he's involved, the more he'll know how to handle things.

    He hasn't received anything yet. The delay is because he is at university and had not collected his post from home (the address his car is registered at) - ive gave him my log in for this site and he wll be checking oout (and acting upon) your advice - I will monitor it and make sure!

    My name is Max and my Dad has been trying to help me with this parking ticket. I guess I screwed up not getting the last letters to him in time. What do I do now? When I parked, it was dark and the sign wasn't visible.

    UKCPS may be dodging v.a.t. If, as they claim, this is contractual charge, it is a fee for parking, and thus vatable. Have they accounted for vat on their paper work?
    Ask them for a vat invoice. If they ignore your request, (which they probably will), it is a useful stick with which to beat them if it ever gets to court.

    I cant see anything on their letters about VAT - so next step is to ask for a VAT invoice and hope that they will then drop the whole thing?

    It does not mean they will drop it, they are not that intelligent

    The point is what Deep says is that this is contractual charge which is subject to VAT and as such you are entitled to a VAT invoice.

    They will ignore you but it is a important request which failure to comply is a good whipping point.
    Plus you can complain to customs & excise

    Would suggest you do not contact UKPCS at all. But if you can get pics of the signs at the car park, you may need these later.

    You have lost any opportunity to appeal and contacting them now will show you to be a hooked fish.

    Also see if you can find out whose car park it is as they can get these cancelled.
