Claim and POPLA advice

Yeah I sent an appeal asking for a ticket to be removed but they refused.0
-
Which ticket? The one you now have a court claim for?0
-
All of them were windscreen PCN's , all of the tickets were last year (between september and december) , the date of the notice to keeper I don't know as threw them away
It is UKCPS, yes they issued the court papers
POPLA, unfortunately, is not an option for you as UKCPS are members of the IPC and have been so for over 18 months.
You are beyond any appeal period now (but it would have been a futile exercise even if you'd appealed at the time), so little point in pursuing that line.
You can only try to ride this out if it's a debt collector chain which can be ignored - but more likely these will be pursued through the court system, especially as you are already in UKCPS sights. So you'll need to handle all court papers effectively. UKCPS may be using their first case against you as a tracer, with a further combined approach for the other tickets.
Have you tried asking the landowner for help in getting them cancelled? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I contacted the landowner, very unhelpful and wanted nothing to do with it, just said you have to sort it out between them and yourself, I said you are the landowner, you have the power to get them removed but still denied that and said no we can't0
-
One way of encouraging an unhelpful landowner is to write to them (yes write) stating that you intend to apply to have them joined to the court case. Could they please name the person who will appear for them in court, and give any dates when that person will be unavailable in the next 6 months.0
-
Dazter thank you, would e-mail be sufficient? also how would that work? how can I join them to the court case and for what reason would I do that?, in my letter/email to them shall I say I want my tickets to be abolished0

"Dear XXXXX (landowner)
I will now apply to have your company added to impending Small claims court due to lack of co-operation and
mediation from yourselves. Please could you name the individual(s) who will make their appearance in court and any dates when these individual(s) will be unavailable in the next 6 months, as you are legally required."
What does anyone think of this, advice would be appreciated also can this be sent by e-mail instead of writing?0 -

Poor. You don't tell them what the basis of any small claim would be. You are really out of your depth here judging by your previous posts and anyone half savvy would read that as composed by an amateur.
You need to say that you are initiating a small claim between you and UKCPS and intend to include them on the claim. Then add the bit about the dates, but if they ask you for "Why" and "How much" as well as the basis for the claim, just what would you say?0 -
PPC negotiate? I think not.0

Thank you for the helpful advice Guys Dad, can anyone answer my question on if I try to negotiate with the parking company and they decline can this be used against me in court?0
