Yes, there was signage displayed - but has the ticket not contradicted itself anyway?
Also, if the Mgmt Co do not have a parking contractor, is the invoice not invalid?

The PPC is ES Parking Ltd.
I also have the following from the management company who own the complex the ticket was issued on 'You’ll have to check to see where the ticket came from. We definitely haven’t put any parking enforcement on the site so we are not able to assist.'
I would email the DVLA to complain and say you can't also email a complaint to the IPC because they don't let you just email:

Look below, the IPC insist on your registering for an 'account' before they will 'let' you complain. WHY IS THIS 'OK'?:

So start with the DVLA and show them the email from the Management company and say you are reporting the fact this operator is apparently issuing PCNs where they have zero landowner authority as far as you can tell. If they reply telling you to email the IPC, explain why you can't and complain too, that this makes them unapproachable to consumers.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think photos of the signage should be sent to the management Co , clearly showing the area (shops/houses etc) and ask them again , "can you confirm that you have not hired "scum and Co" "

Hi all,
I have been taking the 'ignore debt collector' advice but have now received a "FORMAL LETTER OF CLAIM" and after reading many other posts, it appears the consensus is that these SHOULD be responded too.
I am also aware their is something called a 'pre action conduct' which I am almost certain the so-called solicitors have not followed despite claiming they have....
I am hoping somebody can give me some advice / template / links on how to proceed.
Of course my 14 days is about half due to the postman so keen to reply asap if that's the best course of action!
I have tried to request info etc several times and been ignored by the PPC so I want to continue to seek information and prove I had been trying to establish facts and the PPC / debt collector / solicitor are scaremongering and have no basis for the 'debt'

Then they go on to say the usual scary rubbish assuming they have won:eek:
This is a begging letter giving you the opportunity to pay.
What these ???? forget to say is:
1: They have to win first.
2: If you lost then you have up to 28 days to pay without any further penalty to you ..... if you pay, no CCJ, no attachment of earnings, no warrant of control application.
It's a solicitor spouting this rubbish that puts the SRA into disrepute

absolutely! It's very stressful and frustrating when you are just an 'ordinary' person though....
I will surmise everything win or lose when it's over..
but would you recommend i reply to this? Do you think I should draw on the fact they haven't complied with the PD?0 -
What did the DVLA say when you complained to them as per advice from Coupon-mad in post #13? I would have thought that complaint would have produced something significant.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Regarding the letter, I think that WH's misleading words are very similar to those used by BW Legal. I would recommend that this OP reads LoveNorfolk's thread, which shows an example of a SRA complaint (as posted last week by pappa golf).
In this case you can't complain to the CSA (debt collector regulatory body) because Wright Hassall are not members but they are Solicitors so the SRA complaint is a must, so take a look at the recent post by pappa golf in LoveNorfolk's thread.*
You must robustly respond to that letter. Earlier you said this (below) so include this sort of thing in your reply to WH:As they have failed to answer any questions with regards to who has contracted them for the provision of their service, justification of the sum etc, no actual proof of evidence, as well as the contradictory information...a reasonable decision can not be made in respect of paying the charge...
...the ticket information is not the same as their rejection letter and their failure to provide this will allow me to reasonably assume that the ticket has been cancelled as I cannot make an informed decision as the keeper

thanks for your replies...
I did not proceed with the DVLA due to the fact that the Mngmt company say they have instructed the PPC to enforce tickets on the land.. (albeit, there is still conflicting info on whether or not the "particular spot" the vehicle was on should be managed by the PPC.... i have a fairly strong suggestion from the management co that they shouldn't - but I'm still not 100% on the actual landowner... if the management co have instructed them, they possibly have justification so the DVLA route was sort of put on hold)
I have tried on two separate occasions to ask the ppc for basic info (basically what the PD says, so i can make an informed decision) and have been ignored. I also offered to use an ADR service and was ignored.
As you can see by the WH letter, they have still provided nothing
I will read the post by pappa golf about the SRA complaint, and take this avenue..
but with regards to responding to WH, still unsure whether to do this?
I'm currently drafting a response as per zzzLazyDaisy's post for an acknowledgement letter so they can't just issue proceedings and blame me for non compliance... is this the right thing to do to cover myself?0
