It's very simple.
If you are asked to sign a new fixed period, you can accept or you can say no.
If you say no, you can be issued with notice to leave, just as you could be at any time after the fixed period expires.
Anything else around that - rent increases, agency fees - are irrelevant.0 -
I own a few houses and think your reasonable and I would never ask you to sign again .why not try find out who owns it 2 ways one write to council tax explain what your doing they have a address of owner not just estate agent , but they will NOT give it you but give them a letter stamped ask them to post to the owner , they should oblige .

Hope helps . and yes the estate agent is probably charging the land lord to renew it . thats why eager and a rollover contract is still legal just give them notice to leave .
Yes if your paying rent why would they issue a section 21 .

I emailed my estate agent as they kept calling my partner and she was getting fed up of them not leaving her alone.
I said we wanted to be rolling tennants and they've replied today to say that option is only open to us if the landlord agrees. And now they want a reason as to why we want to do this rather than sign a new contract.
I know we're entitled to it either way, but I'll happily give a reason.
We've always paid rent on time, both of us work in decent jobs, we get on with all the neighbours and we've never given them a problem. On top of that when we moved in to what was meant to be a clean house I had to spend a full day cleaning away greases and general dirt off most of the floors and surfaces. It wasn't clean at all. I've also cleaned the drive and other slabs and made the house look good.
It's a shame estate agents sometimes feel the need to treat decent tenants like this as they could boot us out after harassing us and get the tenants from hell in for their landlord next.0 -

I would say that you don't need to ask for a rolling tenancy. It happens automatically once the fixed term has expired. No one has to agree to anything as such. You choose to keep paying the rent and the landlord chooses to keep taking your money.
Most of the time these things are hot air dreamt up by the agent trying to get free money using intimidation (legal language and process you may not understand) and fear (losing your home) to get you to play along.0 -
As usual on this forum, members are jumping to conclusions, and being very aggressive to an everyday occurence.
Please do not ignore the agent. They are probably doing the job that they are paid to do.

Their "job" is to extract as much cash as possible from both LL and tenant for minimum effort with zero knowledge of housing law. Most LLs don't realise they're being ripped off.
In this situation I wrote a polite letter to my LL pointing out that the notice terms remained the same on periodic tenancy, so there was no reason for us both to pay the agent a fee for doing essentially nothing.They are an EYESORES!!!!0 -
