ESA stopped what to do

Hi
This is my first time in doing this so forgive me if I go on .....
So my partner has recently been took off ESA work related as he has been on it for 365 days. He was put on due to his epilepsy and depression and over the past year his depression has become worse due to numerous things happening to him this has come to him nearly committing sucide but will not go to the docs as he feels humilated..... But I have persuaded him to go next week :j. I work part time at 24 hours a week I claim child tax credits and child benefit for our son. What I want to know is my partner entitled to any benefits. On the last letter we received to tell him his claim was coming to an end it said that they had already looked at his claim as was not entitled to income related esa. So please if any one can help I would really appreciate it guys ....

    income support?

    Probably best to visit CAB or do an online benefit checker, try Google, think there is one on CAB website.

    his Benefit will have stopped, but his claim will still be live ( NI credits only), have a look at the support group descriptors, and if any apply, ask for a re assessment based on worsening of condition. if he gets moved to the support group payment will re start.

    other than that the only benefits you can get is tax credits, housing benefit ( if renting) and council tax support.

    he wont be eligible for income support because 1. yor earnings would prevent it and 2. he doesn't meet the criteria for income support ( single parent with a child under 5, carer, or within 11 before giving birth or 15 weeks after giving birth)

  • Hi sorry in the late reply we have been on the phone to esa and they have sent a gorm out to claim for incomed related but what i dont understand my hours that i work dont entitle him to it im so confused :mad:
  • No cant claim working tax credits as because we are a couple we need to be working 30 hours between us x

    you can claim WTC for working 24 hours because you have a child

    ESa - ESa could continue if your partner can be placed in the Support Group. This could be the case if participation in the WRAG activities would put at significant risk his health (mental or physical ), or if one of the descriptors listed here apply:

    Tax Credits - Award dependent on Income WTC & TC

    "If you're in a couple and you are responsible for a child or young person, you can qualify for WTC if:
    you are 16 or over and you or your partner works at least 16 hours a week and the two of you work at least 24 hours a week between you in total. For example, you can meet this condition if you work 16 hours a week and your partner works 8 hours a week. If only one of you works, that person must work at least 24 hours, "

    Housing Benefit and Council Tax support - Award dependent on Income and savings

    PIP - if your partner has care needs. Not means tested.


    Get advice from the CAB about the process of moving into the ESa Support Group, and claiming PIP.

    For single parents, the disabled, over 60, couples with children where one qualifies as incapacitated.

    If a couple with children don't qualify as incapacitated it's 24hrs.

    He'll be considered incapacitated if on NI credits through ESA.
