Warrent to enter to change my metre but they left it so that I am unable to get in.

    Thank you Marktheshark and Cashstrapped that is very good advice.

    I have spoken to citizens advice this morning and the person I spoke to is going to call npower and try and talk to them, I'm just waiting for a call back.
    If that does not work I will try what you have suggested.

    A friend has been and had a look (he isn't a professional but is very handy) he think he may be able to pry open a window (upvc) and break off the sliding brackets that open and close it, he had a look on amazon and replacement brackets are only £10, which he thinks will be easy to replace, so that is an option if we can't get in today.

    The children's father is the reason we are in this mess and he is in no position to help anyone at the moment.

    It's complicated but basically this house was bought by a family member of my ex for ex and us to live in and ex was responsible for the mortgage payments, when he went away the owner said they would allow me to stay if I signed a contract stating that would be responsible for all mantanence and repairs and any costs associated with the house, I don't have any other options so I agreed and signed the contract.

    So are you or your ex paying the mortgage? Because if the mortgage is payable by your ex and he ceases to do so, you face eviction if the house is repossessed.
    Whose name is the mortgage in?
    Sounds like you really need to get some legal advice about your overall financial and housing position.

    The house and the mortgage are solely in the owners (ex's family member) name, the original agreement was that ex would pay the mortgage payments and when it is paid off ex and the owner would become 75/25 owners of the property.
    However, due to things ex did that agreement is now no longer valid so the owner and I came to an arrangement where I would pay rent but be fully responsible for the house. We have a legitimate contract and it's all legal.

    I've had a call back from the citizens advice agent, she said npower are adiment the door was in full working order when they left and there is no chance of them taking responsability for it.

    So I'm going to do as Cashstrapped advised and pretty much say word exactly what you stated and hope it works.

    They wont want to go to court as they risk perjury, the district judge is going to want to know why they used a 1958 gas act warrant to gain entry to fit a pre-payment meter, the act only allows entry to make safe an unsafe gas installation.

    Once they are in they use the separate warrant under the 1986 gas act to recover a civil debt.
    In order to obtain a 1958 warrant some mug has to commit perjury and lie saying the believe their to be a faulty gas installation.
    Which is not true is it, they just wanted to fit a pre-payment meter.

    The last place they will want this is in a county court.

    Get a Letter before action in the registered post, the time for making phone calls is now over, it is now a legal situation as they are denying liability.

    True, but we didn't want either world war and both caused GB huge damage.


    Brexit may also cause GB great damage!


    Just to keep it on the subject, the OP won't have the European Court to appeal to if Brexit occurs;)

    Either the OP has a broken window or they managed to get a result...

    However, even getting in through a broken window is no guarantee that you will be able to get the door open. After all that, a locksmith may still be required to get the door operational.

    So....

    Any update?!?!

    I think that technically, you are meant to inform the police you intend to break into your own property and the reason why.

    This is because, if a random neighbour you do not know (or a passer buy) sees you break in and calls the police, they will most likely arrest you until ownership/access rights have been ascertained. Needless to say, this could take a while.

    Informing the landlord may be a good idea too.

    Obviously this depends on how well you know your neighbours etc. and how overlooked you are but I think that is the reason.

    I do not know if that is what Cardew was getting at though.
