new car

bought a new car on the 27th feb this year
having some issues and just needing advice

the car INSP lights came on within 2 days of purchase of the vehicle
after 2 days car wouldnt run at all.. since had a garage look and the ECU has went
when i was asked how long the light was up and stated 2 days then off the guy was surprised as the sensors seem to be affected aswell now through shorts or something ??

not a mechanic here so kind of on a learning curve mad here

anyway i have been advised that as the cars advert was for a perfect condition and in good order i can return it but i may need to in court.. sucks i know..
the few parts i need to know about is
1-- would the ECU just give up like that on a car
2-- if the guy sold it without declaring that the car had faults can i still pull him back (histories being checked on ECU)
3-- can a lawyer handle the small claims court if i need to take the guy to that ?

    new one from after the crash.

    that got sorted out and the insurers paid out for the vehicle.

    bought privately. second hand 3 owners.
    said on the site no faults good runner perfect condition.
    after 2 days the car started to have problems.

    since contact back with the seller he offered to pay for half of the repairs which has sparked a warning light with me. why offer if there was nothing wrong with the car.

    the site has since got back as the car is unfit for road use. and they are assisting aswell.

    yeah since i lost my peugeot i have had a bad string of luck with this.

    Make, model, age, mileage, service history might help.

    56 plate
    76k mileage
    full service history (may not all be available on work as 2 mechanics are baffled with some parts)

    ECU fault main -- 3 sensors faults secondary - non starter and coil packs fine --
    car dies without starting at all -- clicks on turn over -- batteries new bought by myself -- sparks new again myself -- starter motor bought a new one but old one was perfect -- filters done again at my cost --

    car died after 2 days when the lights came on from what i have heard and read thats an uncommon way for it to go as you generally get this in advance. not just die a death. histories being pulled to see if the codes have been wiped prior to my buying the vehicle.

    was a garage masquerading as a private from what i gather. person i bought from not the owner as i know what fronting is so dealt with the person maintaining.

    no the sale was under private as its not a trader (not certain what its called)

    dealt with the gentleman who maintained the vehicles not the young lad at the front.

    as for the crash, was proven the lady who crashed into as the second car damaged also had to claim from insurers due to internal damages on his radiator from my front end hitting his from the push behind..

    Before taking the matter to court, you first have to send A) a formal letter asking for a repair or refund then B) A letter before action (LBA)

    Obviously I am assuming that other options to rectify the matter have been exhausted.

    But in a previous post you said the seller "was a garage masquerading as a private from what i gather".

    Can you clarify as this would be crucial to your rights.

    the garage had 4 cars in the parking area for sale but only with the stickers.
    the ad was found under gumtree searching and the pictures showed it in a driveway. not on the forecourt of the garage where it actually was..
    car came with a full years mot so didnt look further as the gentleman who was in the garage was the same one i spoke to within gumtree via the emails and then the calls and texts.
    sorry short history

    when we wanted to purchase after a short drive.. the guy in the garage i spoke to previously directed us towards the side office area and the younger gentleman and when he said a private sell we went back and dealt with the gentleman i originally spoke to.
    (at my fathers insistence)

    have other information that has been given regarding the ways of contact.
    have sent the gentleman a recorded letter saying the problems and requesting either a refund on the car or a repair. have 2 reports from seperate mechanics stating faults,costs and errors. have offered the gentleman the option of selecting the third garage for the last one aslong as the garage is reputable and not affiliated with his own business in any way.

    From what you are saying the seller is a trader so your statutory rights under the consumer protection laws will apply here.

    It's actually an offence for a trader to to miss-lead a buyer into believing that he is a private seller. One of the obvious ways of telling is whether the car's V5 has him as the RK or not.
