  • Mobiles.co.uk said it, not me. I asked to cancel my contract and they said to contact EE.

    So, i need to reply back to mobiles.co.uk that i demand they cancel my contract or replace the phone?

    It's really not that hard to understand, the contract is something between you and EE, if your sim is working in a handset, any handset, then EE are doing their part.

    If you want to cancel the airtime contract with EE you can, mobiles.co.uk are correct in referring you to EE, to satisfy the contract with EE you will need to pay an early termination fee to end that contract early.

    If you have a problem with the handset then your argument is with the supplier, and only the supplier. Unfortunately the fact you've allowed someone else (even if it is the manufacturer) to work on the handset would weaken any court case you might eventually have to commence against mobiles.co.uk if they won't comply (or don't feel they need to comply) with your handset issues.

  • i understand that ee is the network operator, i dont expect them to replace or repair my phone. I only mentioned that that is what i was told by mobiles.co.uk. I was referring to either mobiles.co.uk or LG, not EE, when i asked who i should push

    You are the one who for some reason is expecting the provider of your SIM card to somehow be involved in fixing a phone they didn't supply and have no interest in...

    Just to add, hopefully this will help to clarify things for you.

    You have a warranty from LG, this is in addition to statutory rights, you have statutory rights that are only enforceable against your retailer (and no one else). Your retailer is mobiles.co.uk.

    You can continue to push LG for service but you are ultimately weakening your case as iirc LG just use private companies as "authorised repairers" and mobiles.co.uk could produce an expert at court (which is where you would end up ultimately if mobiles.co.uk refuse to entertain your statutory rights complaint) to say that the phone has been tampered with by an external party before they were able to examine the phone.

    The court could agree with them.

    You need to start dealing with mobiles.co.uk, perhaps even start using social media to get to CPW and even an email to CPW management to put pressure on mobiles.co.uk.

    Forget about being silly with your network contract (this will lead to heartache and stress for you when EE rightly set the bailiffs on you, default your account, blacken your credit file and possibly even hit you with a CCJ), forget trying to blame anyone not party to your sales contract with mobiles.co.uk (this isn't the same thing as your network contract with EE).

  • i had moved on from that post, i was only passing on the info provided by mobiles.co.uk (in the earlier post) assuming they had referred me to EE in good faith. It didnt mean i expected EE to replace or repair my phone, nor my electricity provider, but they are involved in the contract.

    In the next post, i was referring to LG and Mobiles.co.uk, sorry if it was not clear.

    Anyway, if its going to descend into being a smart !!! i have better things to do as im currently sitting on my balcony in Nerja ;)

    They were referring you to EE in good faith if you said you wanted to cancel your EE contract, as I've already said, you do have a right to terminate the EE contract, BUT it would entail you paying an early termination fee which would roughly equate to £monthly cost x months left on the contract.
